Sorry if it's been asked before, I searched and couldn't find it.

I'm currently in the process of changing jobs and need to transfer my visa and work permit to a new company. The thing is the new company is a very small entity and won't be in a position to meet (what I understand to be) the requirement for having employed 4 Thai people for 3 months.

Is this a show stopper? Any work around? Can it be back paid?

Any help, advice or suggestions would be much appreciated.

In Thailand anything is possible. I was in the same position as you but just did not know. My new company hired me, but what I found out later was that they did not had enough Thai people to legally hire me.

However, there are lawyer firms in BKK that handles the work permit and visa based on work permit for those who cannot legally be employed. My company paid for this. But there are possibilities.

Yes it could be a show stopper, and chances are you will not be able to transfer your WP, under normal circumstances generally quite difficult to transfer a WP between companies unless planned well in advance and both companies and labour office co-operate.

You problem appears to be that new company is not eligable to get approved for a WP, therefore it cannot be transferred

Generally better to travel out of country, get a new Non-imm B (if this is the route you need to go) and start over....in my experience its less hassle than trying to transfer it.

Would suggest you talk to a legal company on this, as at face value the company cant employ you
