My kid is now in an international school, i have been told as a parent i can get a long-term visa but without much more information.. I asked the school and they know about it but they could not really explain to me how it works.

Kid has dual nationalities.

Is there any one who could explain it to me? What are the steps? what kind of visa is it?

Yes, as the parent of a child studying in Thailand you can get a visa and yearly extensions of stay from immigration, under police order 777/2551 section 2.11.

Requirement is that you deposit 500,000 baht in a Thai bank account in your name. It should be there at least 30 days beofre you apply for the first extension and 3 months for every subsequent extension. Also you must show proof of relationship (birth certificate).

I believe they only allow one parent per student to make use of this.

Also im on Tourist visas but i get 60days extentions after the usual 30days for 'family'

So there is no other way than the 500 000baht? I would never keep that much money in an account that yields me nothing.

It doesn't yield you nothing -- it affords you the privilege to remain in the Kingdom for one full year with your child which may or may not be worth a few basis points to you.

i cant prove any of that, i just thought i could get a paper or something that would allow me to get a non-im in malaysia, then just get regular extentions like the language students?

No, only if you are the legal father. With the birth certificate you cna get a non-O visa, but not extensions of stay untill you legitimize the child.

i am, he has dual nationalities but i cant prove any income or whatever related to this and i refuse to let more than 500 baht in my thai bank account that anyone can steal with a bank book.

SCB pay interest montly on their savings accounts..you have an ATM and no restrictions

Is it lack of interest or stealing???.....Thai banks are in fact less prone to fraud than UK banks.......without either a signed copy or original passport presented by you or accompinied by an P.O.A the passbork is useless.

Yes thats the problem, every 150 days i have to get a new visa, its not the end of the word but since i was told that most parents in pattaya get ED visa's from their kids very easly, i thought maybe i could get the same in phuket and avoid a trip to a muslim country

Your child is Thai, so you must apply for an extension based on having a Thai child. For which you have to be the legal father of the child and not only mentioned on the birth certificate.

My child is also canadian. I have a canadian birth certificate/passport for him and we have lived there, so i can go the same way a foreigner would go, no?

If i wanted to show an income outside of thailand, what kind of paper do i need?

It depends on under which natinality your child is staying in Thailand. If as a Canadian, you might be able to apply based on his study. If as a Thai, he is not a foreigner staying in thailand for his education so this rule does not apply. Instead the rules for being the family member of a Thai national apply. (Of course a Thai immigration officer might see it differently).

Income from abroad is proved with a letter from your embassy, in some cases that is an affadavid. It depends on your embassy what they accept as proof of your income.

Keep in mind that you need to have legitmized your child under Thai law. In case the child is 7 years or older this can be simply done at the amphur, if younger one needs to petition the court.

My name on the birth certificate isnt enough? It was enough to get his canadian birth certificat, he has used his both canadian and thai passport to leave the country on a few occasions.. No matter what i am the legal father in canada and that should trump over small non-sense loopholes in the thai law?

It is not the same as legitimizing the child. One can name the pope as the fahter of the child. It is only a claim by the person who registers the birth that mentioned person is the father. When the parents are marreid, the law automatically will asume the husband is the (legal) father. Not married, one needs to make an extra step, called legitimization. Currrently the mother has sole parental rights. if you break two break up, you have no rights regarding the child.

Without proof of ligitimization under Thai law, immigration will not give an extension of stay.

But under Canadian law, i am the father so how does that work? It makes no sense since there is no primary nationality with the child. If she were to leave with the kid, she would be an outlaw with my country, it would be as severe as child trafficking and authorities pursue those even around the world when they know where the kid is.

Anyways i guess ill just keep the 60days until the child turns 4 or 5

The law of the counttry the child is born is takes presedence. If born in Canada, a legitimizations according to Canadian law might do the trick. If born in Thailand, the child will have to be legitmized under Thai law. That is how most countries will see it. If the child is born in Thailand, only Canda might recognize your legitimization under Canadian law.

Note that only in some cases you will be able to legitimize the child when 4 or 5 years old. Most amphurs require the child to be about 7 years old at least. lgitimization by the court is not difficult, but will cost. However, it will be less than a few years of visa runs and 60 day extensions.

My suggestion would be that you try to work out a One-year Multi-entry non-IMM (O or 'B' with a friendly and sympathetic Honorary Thai Consul in Canada whether by actually being in the Commonwealth or by sending your passport to a family member or friend in Canada to forward to such consul while you await EX-Thailand ...

The basis for any such amicable arrangement would be up to you and the Consul ... but would not require your depositing of funds etc.

they changed and nowadays the consulate is a white person who has never been to thailand and probably could not name an other city than bangkok.. The lady is pretty clueless. Even when the fees were waived, everyone still had to pay fees.

For information, I have seen the 60 day visiting spouse/child (777/2.24) issued directly following on from a one year extension in the case of marriage to a Thai (777/2.18); this was in Phuket for a case where the applicant could not meet the 777/2.18 conditions at the time of renewal of a one year extension.

Agreed that 777/2.24 can certainly not be used back to back and quite possibly can only be used once per original non-immigrant visa issued outside of Thailand.

My meaning was they can not be consecrative 60 day extensions of stay as is allowed for the 90 day ED visas. You can add them to a tourist visa extension or non immigrant extension of another type but only one time before getting something else.
