My partner is a Filipino citizen, we want to move back to Thailand and enroll her into a Thai language course, we have a 3yo and 1month old, will they be included on her Non immigrant ED visa?

If not what do you advise? I work outside the country 5 weeks on/off so will use tourist visa's.

Any advice appreciated

No, the children will not be covered in her mother's non-ED visa. They will need their own visas, eg toruist visa, to travel to Thailand. After arrival in Thailand and having started her course, the mother will get her extensions of stay for the reason of study under clause 2.9 of the Police Order 777/2551. Children of that age are not made to pay overstay fines and and usually parents just let them overstay. The alternative would be separate extensions of stay for each child as dependants of the mother under clause 2.11, which would turn out to be rather costly with a new extension every 90 days.

How long an overstay before Immigration would start getting upset?

Are there any other forum members doing this that can fill me in please?

Children under the age of 14 are not charged overstay.
