Hi, I was told to leave by my employer but they refuse to issue a release letter. Can anyone tell me if this will complicate my visa application in my next job?

Yes. They must give you a letter and with that you must cancel your work permit. If they don't give you the letter, go to the labour office and cancel your work permit yourself, explaining that your employer refuses to give you a letter.

If you are on an extension of stay based on your employment, the same goes for immigration. You must leave the country the day your employement ends, in case of an extension of stay based on employement!

If they told you to leave then it sounds ominous. If you were on an extension of a Non Immigrant Visa, then your visa has ended the day you were fired/last working day. So address that situation, tell the company you require the letter for Immigration purposes and also to return your Work Permit, using names of Government offices usually gets things done.

I'm on extension of non immigrant visa. Don't have plans to stay on in Thailand but do not want to get into any complication if I were to come back for any reason in the future.

My employer wants me to PAY for my release letter! How absurd is that?!

You are on an extension, but is it based on work or not.

If based on work, visit the labour office and immigration to cancel and have them contact your employer.

If it is a case of unfair dismissal, the labour office is there to help you and can even go to court on your behalf.

Immigration can give you 7 days to leave the country for a fee of 1,900 baht.

Do you have any plans to come back to Thailand?

If they are not willing to give you the letter, then I would book my ticket out of Thailand, on the day I was leaving I would give my Work Permit in at the labour office, then fly out.

If unfair dismissal you can still take it to the Labour Office. Am also sure that there still is a notice period in the

contract even when on probabtion.

I will definitely come back as a tourist, not to work. Do you know if I will have any issues at the immigration?

But you do have a copy ?

Dont believe there is legal requirement for you to hand in your WP these days, but in your case think it would be advisable to take a trip to the labour office with copy in hand (or email them) and tell them your ex-employers are being d*kcheads as regards the letter, and you have officically finished work and you are leaving.

If you are on extension of stay for work, and the company had got rid of you, you could now be on an overstay, so need to get that sorted out as well

The DOL is a pretty good dept to deal with.

If you dont want to do any of the above and you go the airport, cant see you having any issues with immigration when you leave,

Does anyone here have a sample of release letter?

A release letter is just a simple letter from the company stating that your employement has been terminated per such date. (preferably today or a date in the future).

It should of course also clearly identify you (Mr ********, of **** Nationality, holding passport number ***********) and be on the company letter head.
