Hi,

I was recently issued a one year work permit, and a one year visa stamp from phuket immigration. Now I no longer work for my employer, so what is my status? I have a visa stamp(see attached) valid through 2012, but if my permit is cancelled what would happen?

In otherwords, can I stay here soley because I have the one year stamp on my passport? So if I try to leave 6 months from now when I go through immigration on the way out will they somehow know that my permit was cancelled and then issue an over stay?

Hopefully I can stay here on the visa stamp!

Thanks

If you were on a one year extension of stay granted by immigration, you are here illegally now. Your permission of stay was tied to your WP. The day you no longer have that reason to stay you must leave. In the past you had a week or so, but now the rules are the same day. You may go to immigration and get one week for 1900 baht, but again if your employment ended so did your permission to stay (regardless of what they stamp says!)

People who have a valid multi-entry visa can do a border run. (In other words if the visa is still valid you can re-enter on the same visa.) If I were fired on Monday I would legally have to report to Immigration on Monday, and then either pay 1900 baht for a week extension or leave the country as my visa was granted in Perth in 2009 and expired in 2010.

One could possibly assume the OP is on an extension of stay for employment, based on his reference to being issued a "visa stamp" by Phuket immigration, therefore would be on an overstay if employment is finished and employers has notified DOL and cancelled his WP

correct, and if he attempts 90 day reporting (based on employment that doesn't exist any more) he could be nailed for fraud too (but I doubt that would happen!)
