I am flying to KL with my son to get him an Ed Visa based on the fact that he attends an International school here in Phuket. I want to get an O-type visa based on the fact that I'd be his guardian here while he is at school.

I tried ringing the Thai embassy in KL to confirm this is possible but only get voicemail. I rang Singapore and they told me they would only issue an O-type visa to the mother and not the father?

Has anyone in my situation gone to KL as a father and gotten an O-type visa based on their son having an Ed visa?

I look forward to hearing any responses..........

If the child get extension of stay by immigrations in Thailand you can apply for dependant visa.

From Police order 777/2551

2.11 In the case of a family member of an alien who has been permitted to stay temporarily in Thailand for study in an educational institution as set out in clauses 2.8 or 2.9 (applicable only to parents, spouse, children, adopted child or the child of his/her spouse):

Permission will be granted for a period of not more than 1 year at a time.

(1) The alien has obtained a temporary visa (NON-IM);

(2) Proof of family relationship; and (3) In the case of spouse, the marital relationship shall be de jure (legitimate) and de facto; or (4) In the case of a child, adopted child or child of his/her spouse, the said person must not be married, must be living with the applicant, and must be less than 20 years of age; or

(5) In the case of parents, there must be an account deposit with a local bank made in the name of father or mother of not less than Baht 500,000 as shown in bank account transactions for the past 3 months. For the first year, it should have that said amount in the bank account for not less than 30 days at the submitted date of the application.

You can not obtain an extension of stay for a child on visa entry - only after child extends on basis of study would you qualify for one year extension of stay but only if you meet the below conditions (note 500k in Thai bank account):

(1) The alien has obtained a temporary visa (NON-IM);

(2) Proof of family relationship; and (3) In the case of spouse, the

(4) In the case of a child, adopted child or child of his/her spouse,

ok - I think I understand the implications of what's needed when I want to extend in thailand. What happens in KL? I apply for Ed Visa for my son and what type of visa do i obtain? I thought it was just an O type visa? Is this the same as the temporary (Non-IMM) visa mentioned in your point 1. ?

This is what my son's school told me:

"...Yes if you and your son go together, you will obtain Visa, type ‘O’ for you and type’ ED’ for Jack. When you go to the Thai Embassy in Singapore or KL, I don’t think you don’t need to show the bank statement, you only need to show the bank statement when you extend your visa in Thailand. Please check the embassy website.

Then when you come back to Thailand with this visa, you will only allow to stay for 3 months. You have to deposit the money in the bank : 500,000 Baht straight after arriving or may be before.

Before this 3 months visa expires (perhaps 1-2 weeks), you have to get another letter from school to present to Phuket Immigration with bank statement, etc.

Phuket immigration will extend your visa another 9 months.

Then before that 9 months visa expires, you come back to school get another letter, go to Phuket Immigration, they will extend another 12 months for you. Meaning you don’t have go to apply for the visa outside Thailand every year."

You attempt to obtain a non immigrant O visa but as they have told you they will not issue you may not get it - after son on extension of stay believe they would issue however.

As for your quote the money only needs to be in account 30 days prior to extension of stay.

Ok - now I'm confused??

Firstly, it was Singapore Thai embassy and not KL that said they wouldn't issue an o type visa to me - they said they only issue them a child's Mum (she was quite rude about it too)......

So when can i apply for the extension of stay for my son? And after I get the extension of stay I have to fly to KL and apply for O type visa?

I am going by the quote you mixed into your last post which said "When you go to the Thai Embassy in Singapore or KL" and your previous statement that the only Consulate you could contact said they would not provide for simple ED visa child. As I said you try for the non immigrant O visa for yourself but if unable to obtain now you will probably be able to do so after your child has an extension of stay in his passport.
