I am here wanting to ask some questions and maybe get some answers for our second visit for my g/f to oz..Using 48r form

1 My g/f first got a visa granted in august and stayed about 6 or 7 weeks due to health matters in her family.. Does she need to tell them as to why she went back to Thailand earlier than her 3 months stay? Or does it look good on her application?

2 When we first applied for her visa and i was her sponsor, She had just finished University and since she went back she has not worked, but i have travelled back with her then back again in november , I dont know if becuase she is not working that they will refuse visa? Yes or No ??

3 I have sent money western union and kept my phone records got lots photos and all my relevant documents from first time also some stautory decs from relations who met my g/f

4 Q2 on 48 r form asks to tick either 3 month short stay or long stay !! If she decides to tick long stay more than 3 months and they refuse long stay will they allow short stay? Am i better off just to tick 3 month stay again like last time?

5 On first application my g/f had to graduate in university in january 2006 and i am thinking that they granted her visa on the grounds she will return to Thailand because she has to graduate ?? Now she will have already graduated by the time we apply for second visit to Oz so i am guessing they will want her to show some reason for why she will return to Thailand?? She has 15 Rai of land i know not a huge area but would they look at that document which states she has that land

as a good reason to return?

6 As we are wanting to marry !! Yes marry, We have decided to go to laksi and register for marriage, but as we will be registering for marriage a week b4 applying for visa, would that help our prospects for second visa? Or should we not tell them about registering?

7 Q34 on 48R it states about whether she applied for temporary entry to Australia in last 5 years ? Does she have to complete this section?

8 Her first visa was single entry. Does that make any difference in applying second visit..

Well i hope i have not bored you all with this but i am wanting to prepare any other documents and making sure everything will be ok and pass.. We dont want to b/s about visa same as first visa..

Your second visa should be a breeze providing it is for next year. I have heard of problems with a second visa being granted when applying in the same calendar year as the first.

Apply for six months. If she goes home prior to the visa expiring, no worries. You will only get a single entry, non-extendable visa. It would be most unusual for them to refuse a six month application for the second trip.

Her passport will indicate how long she stayed in Oz the first time, no need to make any explanation.

As she returned to Thailand in accordance with the dates on her first visa, you won't need to concentrate too much on giving reasons why she has to return to Thailand for the second time.

If you now plan to marry, you should consider making two applications. A second tourist visa and an application for a permanent visa. Submit them both at the same time, but make sure that you write "touring purposes" as the reason for applying for a tourist visa.

Submit all the usual documents and proofs as you did the first time, but keep adding to them in preparation for your permanent visa application.

If she has only had the one tourist visa, then the question regarding temporary entry does not apply to her.

Agree with all MM says except the bit above.....you can only apply for one visa at a time, They wont get their heads around why you are applying for a tourist visa meaning she has to return and applying for a visa where she wont have to return. Putting in 2 applications will see them both rejected.

You really should have a meeting with a lawyer. You can do the application yourself, but a lawyer specialising in Thai immigration would be able to give you the most accurate assistance with your questions. Check Thai-Oz News newspaper. A few advertise there.

See a migration lawyer for a tourist visa???? Bit over the top dont you think??

The application form is simple to fill out, the immi people here will answer a phone enquiry without any hassle if he needs more info.

She has been successful on her first application, as long as he does the same thing and provide further evidence for the second trip, shouldnt have a problem.

I can tell you from personal experience this is not true.

G/f and I applied for third tourist visa. I told them that it was my intention to apply for a permanent visa whilst in Oz.

The supervisor told me that if we stuck with that proposal the tourist visa would be denied.

The supervisor advised us to apply for both a tourist visa ( with reason showing touring only) and for a permanent visa at the same time.

We did and she then approved the tourist visa on the spot.

She stated that if the permanent visa was approved before we left Thailand in accordance with the dates for the tourist visa, the g/f's passport would be stamped as a permanent Oz resident and the tourist visa would be withdrawn and cancelled.

I am not aware of any changes to this procedure.

How long ago was this MM, your post suggests it was pre vfs office days ?

A tourist visa would be denied if you tell them that she intends to apply for a fiance/spouse visa while she is here. The tourist visa will have an 8503 (no further stay) condition and a further substantive visa would not be issued with the exception of a protection visa while she was in the country.

The problems I see with what you were told is that the tourist visa has a use by date of only 3 months after the grant, the fiance/spouse visa will take a minimum of 3 months for approval/rejection. Therefore the tourist visa will have expired before the spouse/fiance visa is fianlised. To further compound this, her passport must accompany the application for the spouse/fiance visa, so once the application has been made she wouldnt have access to her passport to enable the tourist travel unless there were exceptional circumstances.

Just a note on the fiance visa....contrary to popular belief the marriage must take place within 9 months of the visa being granted not from the date of entry in Oz.

My girlfriend (now wife) has been to Oz twice on tourist visas - March 2005 and Feb 2004. The second time was a bit more of a hassle (not at the vfs, Thailand end) because of immigration at Perth. She came by herself - she may have told them that she was my fiance and thats what caused the problem. Immigration immediately thought she would get married in Oz and stay. We both came to Oz for a month and then both had to return to LOS for work.

So I would be a bit reluctant to give any indication that you have longer term plans in mind - but then the other posters could be correct in their experiences.

I would just show all the stuff you have - photos, telephone, land, etc and try for a tourist visa.

It would be good if you could get someone to say they might employ her after she returns to Thailand!! Or maybe she could enrol for a short PG course or something.

My g/f was issued a six month tourist visa for her third visit. It was stamped 'no further stay.'

The application for permanent visa was not approved before we departed Thailand for Australia, but it was approved whilst she was in Australia.

Her passport was photocopied and the original was handed back to her. The copied papers accompanied her permanent visa application.

I can understand what you say regarding passports and the current VFS requirements. The passport now has to be forwarded with the application.

If there is no other way around this requirement it would make travel to Australia impossible until the passport was returned.

I can't see why both a tourist and a permanent visa application couldn't be made at the same time under the current procedure.

Surely suitable arrangements could be made at the VFS office to have the passport returned so that the tourist visa can be utilised.

They need to sight it, not retain it.

It is only because of time constraints that you would submit both applications at the same time. A decision for a tourist visa is quick whereas a permanent visa is more involved. If you have time up your sleeve and can prove an ongoing, genuine relationship, just submit a permanent visa application and forget the tourist visa.

I'm not familiar with the new requirements so I'll be guided by anyone who is. :o

They need to retain the passport for the visa to be stuck on the page..... :D

Any arrangement regarding passports while a visa application is underway would need to be made with the embassy direct, the VFS office is merely a collection point, the application is sealed in front of you and not opened till it reaches the embassy, it is resealed and not opened till you pick up the documents at the VFS office. However I cant see them allowing the release of a passport from the application unless the circumstances were exceptional.

In regards a dual application, the rule is that on a tourist visa with an 8503 condition that no further visas will be issued until the original visa is fully utilized.

So you are right in saying that it is either forget the tourist visa and go for the spouse visa or do the tourist visa then apply for the spouse visa on her return to Thailand.

As or a tourist Visa for the US, I was told it is better to apply for a short visa, and as a matter of procedure when she arrives in the US they will stamp the Visa for a 6 month stay. You do not need to request it. So the application for a shorter stay Visa (knowing they will stamp it for 6 mos) is the better route.

Does this sound right?

Does not apply to Oz Easttech......as I said when you are granted the short stay visa....they wiil not issue a more substantive visa unless there are special circumstances and especially if the 8503 condition is attached. The visa is granted by the embassy and cannot be changed at the Oz airport.
