Thailand.....Rule of Law? Sometimes.......Rule of Man?........Often.......Law of the Jungle?......absolutely.

Abandon any notion of the Rule of Law coming to your rescue at the airport...........your self defence mechanism has to be higher here.

Hope a Thai Lawyer would shine some light on this. There is still no answers to this. Gone are the days that i have to smile pathetically to every guy with a badge. Even though i did nothing wrong.

You keep banging on about lawyers and bogus cop traffic stops. You have been asked to tell us where you have been hit so many times but won't answer. Maybe it's paranoia or all in your imagination as in my +15 years in Thailand, driving days and nights just about everywhere apart from the north and the south, I have never been the 'victim' of a traffic stop by anyone other than legitimate cops.

Thats your personal problem if you never been the 'victim' for 15 years living in Thailand. To assume that i kept on banging about lawyers, bogus stops and that i am paranoia and that i am imagining things up are just really mean & an act of discrediting me in the forum community. I do not want to answer where i have been hit is solely due to because of privacy reason. All that i can reveal is that most of the blocks that i had encountered which is 'illegal by law procedures' are HERE in Southern Thailand. I give another clue the 'deeper down part of Southern Thailand" that is what im talking about. Not your average Koh Samui or Phuket island . Or whatever island u care to name. Although i did encountered some problems too around the northern part of South Thailand. It is nothing much worth mentioning. If you still think im imagining this up. Thats your problem just leave the thread, shut the f up & go somewhere else. Dun even read this if you think it is untrue. Why waste your own precious time ?

I give a few examples that i myself have encountered. I try my best to recall

Hatyai - ( Somewhere near the outskirt, 1am, remotely deserted, afew lamplights on, near remote rubber plantation) Somehow this 'deserted' road will have afew city cars & others 'lost' in this stretch from time to time. There were apprx 15 Or Sors & police volunteers (green uniform with black cap) armed with pistols standing separately in groups of 2 -5. There is no way of escaping or just plainly drive through. U have to stop. Was searched the hell out of my car. Somehow after 10 mins of fiddling around they didt 'feel' like imposing any makeup offences and let me go. Keep in mind that these are ALL volunteers. Any tom dick & harry could join. Even your average Thai who was a 'nang lek wanabe' or your neighbourhood drug dealer could join and given a gun. If you could just spare some of your time to the agency. U are IN. One point to take note is that there are not even one SINGLE Thai police with appropriate rank to witness the scene or manage it. What if they 'magically' show you that 3 yaabaa pills was found in your car?

Phattalung - (Somewhere along Mae Khri area, past midnight, stretch of highway, 2 road lanes)

From time to time. There will be a police stop here. Thing is there is only 2-3 of them most of the time shining torchlight waving for drivers to stop. A friend of mine told me to just bang them down the next time. As in was a illegal check and unlawful according to law. Even if they were legitimate police. The Courts will verdict on our side. They are not allowed to do that as i was told.

Pattani - Military roadblock. Okay this was fine. I had no problem about it. Not sure about others. But i heard sometimes they do misjudge and assume things. And everything just go haywire from there. A Thai friend who was just delivering inkjets in his trunk was stopped and was nearly shot because he answered some questions not to the liking of the soldiers & acted strangely. He was just alittle drunk & tired. He was pointed blank point with a rifle and was asked to lay down spread eagle with his shirt off. Just plain humiliating. But thats his problem. It didt happen to me.

Surathani - Once again this was manned by an all out villager volunteers with afew Or Sors with uniform. Zero police. Cant remember what lame excuse they said to me. Ended up giving 800b just to shut them up. Its was dark and im already way to tired to smart ass them.

Chumphon - Highway Police. Was car searched. Are they allowed to do that? In the end they find fault with my Airsoft rifle brought from Bangkok. The rifle was zipped and stored behind the car. Wanted to impose charge that i was transporting live firearm. Showed them a copy of the law on Airsoft which the dealer gave it to me for situation like this. That shut them up completely. Was send my way out.

There are still many countless encounters to list and i am too tired to bare it all in this forum. I drive long distances every often. And i like to drive at night most of the time. Thats why i keep encountering these punk ass checkpoint.

This is REAL people. Really hope someone can shine some written Thai laws on police stop. With knowledge, hopefully they will stop preying on the ignorant. And bring down corruption at least to an extent. They Thai police are given too much arresting powers. This have to end.

People on here are saying that they drive straight through the check points though - really? I would have that they would be on their bike and after you in a split second.

@OP you don't need a lawyer for this. If the police tell you to stop you stop. If they want to search your car, you have to let them. If they want some tea money you have to give it to them. Your choice is to stop or not.

I got a Thai friend who did exactly that and he was chased by a bike with a gun pointed at his car side window asking him to stop.

What if they dun want tea money? What if they want something else? Sexual favours from wife, the fiancee or perhaps girlfriend ? Im not saying that this happen very often. But it does happened, i believed there are much worse cases than just sexual favours. Some were raped

Most of the places you mention are not considered deep south apart from maybe 1. You mentioned 4 or 5 incidents , in 1 it was about a friend who you say was a little drunk, where is your problem with him being stopped ??

The other notable 1 was when you had a rifle in the back, you gave them the correct paperwork and you drove on...again where is your problem??

Thailand has a problem in the South with drugs and terrorism any country would have police checks in areas like this.

Like the saying goes if you've nothing to hide why worry ?

Why don't you just contact a local lawyer and ask him to take up the case your next hard done by stop ?

In the local paper, a month or so ago, in Pattaya, a fake officer actually took a person into the police station for drug tests.

You can't make this stuff up.

Ummm... yes you can if you don't provide a link to the true story.

The Banglamung Station colluding with fake police, kidnapping for ransom is what they are up to.

Some people here in this forum still dun get the god d_mn message here im trying to ask. I dun have any extreme problem with being stopped or car searched. Or being asked to step out of the car in the middle of the wee morning out of nowhere with my wife or daughter or visiting female friends standing vulnerably on the deserted roadside with no one else to witness in case of bad things happens. Completely in the mercy of these people manning the roadblock. Some of them probably alittle tipsy on alcohol. Some maybe on weed or ice/yaba or whatever before gathering for 'duty' .

If they want some money. Even if i done nothing wrong. Thats fine with me even though its sucks big time... But what if one of them has a boner ? a hard on ? a sudden crave for lust. And start requesting for sexual favours from the ladies in the car? What the f are you going to do then ?

All i am asking is that can one REFUSE a CAR search in Thailand. All i know is that to search a person house or private room or whatever. They need a letter from the courts. Signed by a judge. I AM NOW asking about a private car.

Although the following below link has nothing to do with a car search. It show that one has the rights to refuse to reply to an officer. But this was in the US. I duno about Thailand.

You are trying to split hairs which don't exist and are also confusing procedures with laws.

You must obey a lawful directive from an empowered official. Full stop.

Refuse and you may get shot. The judge or the coroner may rule on the legality of the order afterwards.

They ask for 300,000 baht to close the case. What your gona do doc ? You replied you dun have that much. They want a 3 min blowjob from your gf/wife in the dark bushes. What your gonna do doc ? Comply willingly ? Cos its the law ?

This is fantasy, you have produced a single case of any such incidences, and in any event, at a nighttime check point you have no way of assessing who is present before you stop.

A marked car could pull you over in a traffic stop and do the same, they could also come knock on your door at home with the same plan. A search in this case is not required for them to set you up if that is what they want.

I disagree. You *do* have an extreme problem with being stopped. Or an unreasonable phobia, or you're trolling. Making up horror scenarios out of thin air and then yelling at people who point out that your fear is unreasonable may be entertaining to you, but any connection with reality, if there ever was one, is now lost.

AFAIK you sure have rights to refuse car search and perhaps alcohol checks and answering questions, officers in turn have the right to let you go or hold you until they get a warrant if you insisted. Also, AFAIK it's illegal in at least some states in US (if not all) and in some provinces in Canada to videotape the police on duty.

I can't give you the legal answer, you better go'n talk to a lawyer, but I am sure it won't be a smart move to ram through a check stop be it legal or not in your opinion. It's also not smart to play a smart ass as the guy who make that video with any police in the world.

If you're bothered that much by the check stops then stop driving or move to another area

Arent they not have cases whereby innocent people have been framed here during car searches in Thailand? No ?

Authorities looking for a quick bucks. No ?

Authorities asking for sexual favours. No ?

There is cases much worse than this. It had happened !

i have seen no news

or heard ANY stories

of frame ups in thailand

not that it does not happen

in issan there may be bandits at night who stop and steal cars etc

basically the answer is NO

you can NOT refuse to stop for the police if you hit a roadblock at 3am in the middle of no-where

if they are fake police/criminals dreesed as police thats another story entirely but sworn police wearing uniforms and packing sidearms

you should probably stop and pay whatever fine they ask for for any reason ,people have been killed for much less

even if you suspect the police might be not authorised ,you could be wrong and running them over or blasting through their check point

could get your car riddled with bullets whether theyre real cops or not and if you run over a real cop in your 4x4 you will have a be a very

sorry puppy when they catch up with you

i hate stopping for them because i know being a farang its beer money and likely none of it will ever make the station but i still stop more than 70% of the time if they have effectively blocked the road (on a sportsbike thats way faster than anything the cops have ) :)

if im in a car id pull over because they have all the advantages then

I don't think it's an issue if the guys running the traffic stop are legit or bogus. If they have firearms, you better stop.

Time for the OP to take his own advice and <deleted>, IMHO.

(or stop driving about in the middle of the night with women passengers may be a start)
