I have a NON B Visa and am working in my Thai Company, but it expires in 2 weeks time.

To extend i understand all the documents i need including:-

Audited company figures, tax return, list of employees, etc etc etc, there is no issue apart from the following

The Audited company accounts for last year are non yet complete

I have just received my tax assessment, and it will be paid, but my visa will have expired by then.

There is no company tax assessment as yet, as the accounts are not complete, we have a lot of transactions, so it is not simple to get the accounts done.

How can extend my NON B visa, when it expires before the accounts are complete?

I do have a work permit valid to Dec 2012

If i let the visa expire, and re-enter on a normal tourist visa is that ok?, then re-apply for a NON B overseas when all the accounts are complete?

Seeing the documentation required, it appears as if it would be far better if i get the next visa mid year, so that all requirements have been completed when i apply for the extension.

This is the companies first year of trading (has 2 months last year, but not much there)

What does the working capital of 1M bht mean, we have a company of 2M in registered capital and have invested 3M into it, but i do not have 1M in cash in the bank, or when i do it is not there long after all the salaries have been paid etc.

We have 8 thai employees so no issues there.

Extension of Thai Business Visa

The Thai "B" or Business Visa can be extended to a one year visa in country as follows.

The extension of the visa is normally based on employment and as such there are certain regulations governing the company who is employing you.

These are the regulations for the extension of the "B" Business Visa:

1. The business must be registered in Thailand.

2. The company must be capitalized to at least Baht 2 Million while operating fund must be at least Baht 1 Million.

3. The company must have a ration of at least 4 : 1 - Four Thais for every foreigner.

4. You must earn at least in accordance with the level specified for each nationality by the Labour Department.

Duration of the Extension

- One year at a time.

Documents required for the extension:

1. Application form (T.M. 7 )

2. Passport or document used in lien of passport and its copies .

3. The applicants 4 x 6 cm. photograph .

4. Extension fee Baht 1,900.-

5. The company letters certifying as follows ;

- Nature of business

- Reason or necessity in employing the applicant his / her position, salary and education background.

- Number of Thai and foreign employees.

6. Copies of work permit or receipt of work permit application.

7. Company's annual balance sheets.

8. The juristic persons Annual Income Tax Declaration Form (Form No.50) of the latest year and its receipt of payment.

9. Thai employees Monthly Income Tax Declaration Form (Form No.1 ) of the latest month and its receipt of payment.

10. The applicants Annual Income Tax Declaration Form (Form No.91) of the latest year and its receipt of payment.

11. The official letter that certify the registration of such juristic person.

12. Business Registration or Business License.

13. Value Added Tax Registration and list of share holders.

14. A map that indicate location of the Company.

15. For those who operate export business, the documentary evidence clarifying its export activities is needed.

16. For those who operate tourism business, the documentary evidence clarifying its total number of tourist that brought in by the company is needed.

Some Immigrations offices.

17. Picture of all the company's employees at work

18. Picture of all company's employees in front of the office with clear name of the company showing

N.B. In case of necessity , documents No.7 , 8 , 9 , and 10 can be substituted by the company letters stating its reason.

Operating fund means revenue.

Anyway, if you don't get your extension you will get a new non-b in the region with your work permit and company papers.

As it happens i have to apply for a new passport anyhow, as i only have 2 pages left in the current one, by the time i get my new passport the NON B will have expired, anyhow, if it is extended, they will probably have to space to put in the passport by the time they process the paperwork, as i travel at least 3 times per month to the Asian region

You can not extend without the required financial paperwork - but you can get a new non immigrant B visa and that is what you need to do. You can not work on a tourist visa entry. So go out now to get a new visa (they may issue multi entry if you feel you will need that amount of time to get financials in order) and re-enter on the new 90 day B visa entry, get new passport and then extend if you can or make new entry(s) on new passport.

Does the 90 day B visa require less documentation that a 1 Year B Visa, i have looked at some websites on this, and the requirements are almost identical, if i do not have the documents now, then how can i apply for a 90 day B visa?

I believe it is the extension of stay that recently requires higher financials paperwork but if you have work permit the visa can be obtained with slightly less strict accounting. Hopefully someone here on work status can provide a more detailed answer.

For an extension of permission to stay on the basis of business/employment you have to submit the most recent accounts, which in your case will be last year's accounts.

if your company is fairly new and does not have these accounts then an extension on this basis is not posssible, that is until these accounts are available.

Lopburi is quite correct, in that the finacials/company paperwork requirement is less for a Non immigrant B Visa which is obtained at a Thai Embassy/Consulate outside of Thailand.

Company paperwork is the same for a Single Entry 90 day vs. a One year Multiple Entry Non immigrant Type 'B' Visa - the actual requirements differ from consulate to consulate but you certainly need a current valid Work Permit for a Multi Entry non B.
