CHIANG MAI: -- The Election Commission is duty-bound to organise the Chiang Mai by-election within 45 days to fill the House seat vacated by former Pheu Thai MP Chinnicha Wongsawat, EC member Sodsri Satayathum said yesterday.

Last week, the Supreme Court found Chinnicha guilty of filing a false asset statement and barred her from holding office for five years.

"The by-election must take place within the deadline regardless of an appellate review," she said.

She said Chinnicha had a right to try to overturn her verdict but at the same time the EC could not wait for the outcome of the appellate review due to time constraints.

The Pheu Thai Party will not nominate its candidate to replace Chinnicha before the completion of the appellate review, party spokesman Prompong Nopparit said.

Prompong said he was confident Chinnicha could clear her name based on fresh evidence.

Fully realizing that these Shinawatra/Wongsawat clan members are not exactly paupers, there's some degree of solace gained from remembering that the last time an MP got disqualified, unsurprisingly from the struggle-to-follow-the-law Pheu Thai Party, it was reminded that Chinnicha is liable to pay for the cost of the upcoming by-election in Chiang Mai.

Pheu Thai MP disqualified

The Election Commission has disqualified Pheu Thai MP Distad Khumprakob on the grounds that he had not been a resident of the Nakhon Sawan constituency long enough. Under electoral law, a candidate must maintain a residence for a minimum of five years in a given constituency to be eligible to contest elections to Parliament.

The EC will forward its ruling to the Supreme Court's Elections Division for judicial review.

Should the high court endorse his disqualification, Distad is liable to pay back the cost of holding a by-election.

Let's see who from the Shinawatra/Pombejra gang steps up to take her place. There may be some second cousin or in-law left, or else they'll have to start fielding their pets as stand-ins.

They could always go with the brother, that was so incompetent that it was decided against running him for the PM position and forced the reluctant Yingluck to take, with the great campaign slogan just waiting to be utilized.

I have to disagree with your suggestion. There is no reason any MP should have to give up his seat because he faces unproved accusations, and this is the reason the immunity system exists. Of course it is open to abuse, such as the nomination of accused candidates to help them avoid prosecution.

A better system is "pairing" where when an accused MP is absent from parliament, another member of the opposite party is not allowed to vote until the charges are heard and guilt decided. Not a hard system to implement, but not likely while THIS government has a substantial portion of their party list profiting from their immunity.

Although I don't know the details of this case, I seem to recall it was an allegedly fairly gruesome affair with several shots fired into the victim at close range. The immunity clause prevents the main suspect from being investigated which must be traumatic to say the least for the victims family, knowing that the suspect is walking around 'untouchable'. in this case his immunity is a hindrance to justice and i think, on balance the right of the MP to be protected from false allegations should not outweigh the responsibility of the authorities to find the victims killer.

As for the OP well I bet Cinnicha is happy Auntie Yingluck was able to come back from Japan with millions of Yen in 'investments' which she'll 'gift' to her to cover the cost of the by-election. Cinnicha is a Shinawatra we all know any cost from this by-election will cost the dynasty sweet FA. Mind you it would put the cat amongst the pigeons of the Dems or another party won a CM seat. The boat may start to rock.

I think he would rather turn it into a forum on the government making good on it's promises and paying attention to the needs of the people more than the will of one man who chooses to live in another country.

Constituency 3 By-election in Chiang Mai Set for June 2

BANGKOK: -- The Election Commission has set June 2 as the date for the Constituency 3 by-election in Chiang Mai while awaiting the issuance of a royal decree to make it official.

Meanwhile, the Pheu Thai Party announces that it will not field the children of former prime minister Somchai Wongsawat in the by-election.

Election Commission Deputy Secretary-General Boonyakiat Rakchartcharoen said the board has resolved to propose June 2 as the date for a by-election for Constituency 3 in Chiang Mai Province and May 27 for advance balloting.

Applications for the by-election will be accepted from May 7 to 11. The proposal will be forwarded to the Cabinet which will seek the issuance of a royal decree to make the dates official.

Pheu Thai Party deputy spokesperson Sunisa Lertpakawat said the party will not field the children of former prime minister Somchai Wongsawat, Yosthanan, and Chayapha, in the by-election.

The by-election is required after former Pheu Thai MP for Chiang Mai Chinnicha Wongsawat was disqualified by the Supreme Court's Criminal Division for Holders of Political Positions for a false declaration of her assets.

However, she added the party has one applicant who is in Chinnicha's support team.

There is no pairing system that would cover an absence for an MP on a murder charge; parliamentary immunity in Thailand is farcical - in other countries it means immunity for what is said in the House, not for criminal acts outside.
