I have a visa based on marriage,i have just done my 90day report,this will expire on sep 12,visa needs to be extended on october 11, 12months finished.

I would like to change to an education visa as my marriage is on the rocks and i am under 50 so ed visa is the only one that fits for me.

I have a young child with my wife and we have split amicably,son stays with me 2 days a week.

Can i go in for the 90 day report in september to give me another 90 days or do i have to have visa changed before the september date?

Can i change it here in thailand or do i have to leave the country

Is there another choice,i don't work here and don't require a work permit

You could get an extension based upon having a child with Thai nationality. The financial requirements are the same as marriage. How difficult it is to get will depend upon which Immigration office you have to use. Some will accept just the birth certificate showing you as the father others want a court order.

Have you gotten divorced yet? You will be ok for your extension until it runs out if not divorced. If you do get divorced try to get custody of your child because that would make it easier to get an extension. Joint custody might also be ok.

If you want to do the ED extension you should be able to change to that without having to get new visa outside the country.

You can do your 90 day report just like you always do.

Not divorced yet,i don't want full custody,childs only 8months old and needs to be with mum.How much notice do i have to give to change visa to e.d,can i do the 90 day report in september and then change over in late november,or because my 12months runs out in october,do i have to do the change before that date?

You would have to do it before your current extension expires. So that means you have to enroll in the school and get all the documents together that is required to get the extension.

You could also get a 60 day extension based upon having a child if you need more time.

You can only get an extension if you are not only married but also living together.

When your extension will end is when the reason for the extension is no longer there. The day you get divorced you have to leave Thailand. But at that time you could ask immigraiton for a 60 day extension to visit your child.

90 day reporting is not extending your stay, you say you extended till Oct 11th. That is the day you have to leave Thailand (if not divorced before). But as said, you could get a 60 day extension based on your child.
