Hi my wife and stepdaughter have been here 2 years in November at which time we will apply for ILR as it will have been 2 years.

Now my 17 year old stepdaughter decides she wants a local part time job at the Coop shop nearby, They both have NI numbers.

On the coop application form it states that they require evidence that they have the right to work in the UK, I am not sure how to do this, or even so maybe neither of them are allowed to work in the UK?

Any help would be much appreciated as my head is exploding looking at the UKBA website!

Having an NI number does not necessarily mean that someone has the right to work in the UK.

For example:-

A person is in the UK as a student and so legally allowed to work for a maximum of 20 hours per week. To work they need to have an NI number and so they apply for and are given one.

Once granted, an NI number remains with you for life.

The foreign student finishes their course and returns home. A year later they return to the UK as a visitor. Visitors are not allowed to work; even though they may have an NI number.

However, silverdales, your wife and step-daughter have settlement visas and have been allowed to work in the UK since the day they arrived (subject to your step-daughter being old enougfh).

Any prospective employer will want to see their visa as proof that they can work in the UK.

No problem with working. the temporary leave to remain that your step-daughter has (presumably based on her mothers leave to remain). She should take her passport with her so the Co-op can check and photocopy the visa page.

She should keep them informed when ILR is applied for. A copy of the confirmation of application from the UKBA that comes back once the application is received should keep the employer on the right side of the law while it is being processed, Tthen a copy of the residence permit when it arrives!

An employer has to show that they have taken reasonable steps to ensure someone is eligible to work.
