daniel_temp Posted July 10, 2012 Posted July 10, 2012 Hi my girlfriend and i have been together for 6 years and in may 2012 she has been living here for five years, these are the visa's and dates: 3 month visiting visa from 19 may 2007- 17 aug 2007 student visa 20 oct 2007- 17 nov 2008 student visa 4 feb 2009-5 march 2010 unmarried partner 23 june 2010- and visa finish 3 september 2012 so since may 2012 its been over 5 years is she eligible for british citizenship? i heard the visitng visa doesnt count is this true thankyou for taking the time to answer
7by7 Posted July 10, 2012 Posted July 10, 2012 As she is not the spouse or civil partner of a British citizen she needs to have had no time restriction on her stay in the UK for at least 12 months. From what you say she wont be applying for ILR until September 2012, so the earliest she can apply for citizenship will be September 2013. She also needs to have been legally in the UK on the exact day 5 years before submitting the application and during the intervening 5 years have spent no more than 450 days in total out of the UK with no more than 90 days in the final year.
