Cambodian troops 'fire at passenger jet': Thai army

BANGKOK, July 12, 2012 (AFP) - Cambodian troops fired shots at a passenger aircraft flying near the country's disputed border with Thailand, believing it to be a spy plane, the Thai army said Thursday.

"The Cambodian military fired because there was a Thai passenger plane -- Bangkok Airways -- which could not land at Siem Reap airport because of bad weather," said deputy army spokesman Colonel Sirichan Ngathong.

"It was misunderstood by Cambodia to be spy plane," he said, adding that no one was hurt in the incident near the northern Cambodian tourist destination of Siem Reap.

Cambodian military at the border -- the site of deadly territorial clashes between the neighbouring countries last year -- confirmed troops had opened fire at an aircraft.

"It was dark so we could not see what type of plane it was. But it was circling many times and then our soldiers fired 18 shots from a machine gun, but it missed the plane because it was flying very high," Commander Seng Phearin told AFP.

"I think a passenger plane would not fly around the border. We suspected it was a spy plane, so we fired to defend our airspace," he said, adding the aircraft had been around 10 kilometres (six miles) inside Cambodia.

He said the incident happened at 19:00 local time (1200GMT) on Wednesday, although the Thai authorities said it occurred Thursday morning.

AFP was unable to immediately contact Bangkok Airways.

Cambodia and Thailand traded heavy arms fire over a disputed border in early 2011 under the previous Thai government, but ties have warmed significantly since Yingluck Shinawatra took power in Thailand.

Yingluck, whose brother Thaksin has remained close to Phnom Penh strongman Hun Sen since being deposed from power in a 2006 coup, is due to meet the Cambodian leader for talks in Siem Reap on Friday.

The meeting will be on the sidelines of the largest ever gathering of American businesses in Asia hosted by US Secretary of State Hillary Clinton and attended by a score of regional dignitaries.

Bangkok Airline is cheap airline....no risk that any family member sit inside.

Badaboom. Thai army having a scrap one day before the biggest legal court decision in Thailand history.

expect huge movements of armoured vehicles through Bangkok tomorrow on their way to the Cambodian border.

Strewth, it is so obvious I can't believe no one thought about this as being the entire train for this story.

A spy plane ??? spying on what ??? at that time, maybe they were looking how many men manned the machine gun. Flaming ridiculous- it is so stupid-it has to be a joke. firing a machine gun at a high flying aircraft, trying to frighten the pilot ??? who wouldn;t even know some plonkers were down there. They said they were WARNING IT, Ha Hacheesy.gifcheesy.gif

It's just an excuse for the army to.move through Bangkok tomorrow.

Occurred to me early, but I was not online.

Same old same old. Nationalism is the last refuge of the scoundrel.

Then again a good excuse to mobilize the army prior to the redshirts called for

fight to the death if they don't like the ruling, makes perfect sense from a security standpoint.

Curious also that 'Yingluck is reportedly going to Cambodia tomorrow'.

Could this be a way of scuppering it without face lose?

This is a fairly amazing event even for the ongoing weirdness of SE Asia...... Guess things will be abundantly clear by tomorrow if Bangkok is full of soldiers. Or the soldiers could just head straight to the border and avoid Bangkok ????

While it may be odd for a plane to be flying around the border, it is more odd that the Commander things it appropriate to fire machine guns at a high altitude plane or firing any weapons at a plane without first checking easily available commercial radar tracking considering the plane was clearly not posing an immediate threat and he didn't even have any clue what type of plane it was.

The Commander concerned should be relieved of duty. In terms of air traffic what the cambodian military did is an international violation and whilst there seems to have been many jokes on this thread, the simple fact of the matter is thank <deleted> they did not hit and critically damage the aircraft. HOW can the cambodian commander be protecting cambodian airspace without first contacting the appropriate civil aviation and military aviation authorities! mad.gif

On May 10 [1984][..,] the members of the ICAO Assembly unanimously

adopted Article 3 his to the Chicago Convention, which

provides:

(a) The contracting States recognize that every State must refrain

from resorting to the use of weapons against civil aircraft in

flight and that, in case of interception, the lives of persons on

board and the safety of aircraft must not be endangered. This

provision shall not be interpreted as modifying in any way the

rights and obligations of States set forth in the Charter of the

United Nations.

While there is no definitive international law that restricts firing

on civilian aircraft.l'" international law has developed to the

point where, while not universally accepted, there are norms

that are sufficiently widely accepted that the "right" to fire on

aircraft that offend a country's airspace is quite restricted.!'"

The criteria proposed at the end of Section VI above likely meet

that standard. Moreover, that proposed standard, while quite high,

balances the humanitarian desire to avoid firing on civilian

aircraft against a country's need to protect its security. In

essence, it restricts firing until an analysis of the situation suggests

that the aircraft is, in fact, a military threat-permitting the

use of force as a proper defensive action under Article 51 of the

Charter of the United Nations-or something sufficiently close

to a military threat, that is, a threat to lives from a terrorist plot,

to warrant comparable action.

Bagnkok Airways is not a cheap airline. It is a full service arline.

No first class --> better take the own airplane

of course Bangkok will be full of soldiers tomorrow, ready waiting for a call from hither or thither. Even the coppers have said if they can't control the situation they will call on the army.

wink.png Humour doesn't change! A close friend of mine in the German Air force was flying to London with me on BA to attend a conference. He was sat two rows behind. As we approached finals for Heathrow, he shouted 'hey Jim do you know what my father said the last time he was in this bit of airspace'? caught unawares I just said 'eh'? He replied 'Bomb doors open'! Got a laugh from 20 people! Was he a relative of yours wink.png
