Hello,

I rencently decided to switch my company here, however I am kinda confused about the work permit visa relationship. From what I have learnt and heard so far, when your work permit gets cancelled, so does the type b visa on which it was given. However my present employers assure me that when a work permit is cancelled, it does nothing to the visa which will expire naturally on its expiry date. I am not really sure if this is the case, as even the lawyer of my previous company confirmed to me that typically both the visa and the work permit are cancelled together after which i will have 7 days to leave the country. I have already started working with the new company, however my work permit from the previous company is still in tact as I asked them to maintain it till 15 Dec as I was unsure. I was originally under the impression that by that time the work permit application would have been completed however there have been some delays and now it does not look possible.

How exactly does this work and are my present employers being totally honest with me about this?

If you are here on a visa...then you will be ok until your visa expires, but working here on an extension of stay, then yes when you finish your employment your "visa" expires as well and dont think you even have 7 days these days unless you pay for a 7 day extension.

so to answer your question, do you report to immigration every 90 days or do you visa run ?....if you report to immigration every 90 days to report your address, but dont leave the country then you would be on an extension of stay for employment and the day you finish your employment you have to leave the country within 24 hours or pay for a 7 day extension

The question if you have 7 days or not is determined by if you fall under regular immirgaiton or under the BOI (board of investment) One Stop Service. It seems the One Stop Service gives 7 days for free, if you fall under immigraiton you can apply for an extra 7 days but have to pay 1,900 baht for it.

Also, do you now have a new work permit?

Agree with above if your visa is a B. If your visa is a non 0 multi based on marraige then it's your visa and is not cancelled with your work permit, you keep the visa and continue doing 90 day border runs.. I know some areas don't allow working on an O but some do eg Rayong area.

Ok but the OP was referring to a Non-imm B, not an "O"

Be very careful about this.

A colleague of mine in similar circumstances, went to Laos to get a new visa and was told her work permit and therefore her visa had expired 10 month previously.She had to stump up 20,000 baht immediately.

10 months earlier would mean the person did not have a visa but was on an immigration extension of stay and as said that expires on date work ends.

@Lopburi and @Soutpeel - to clarify, one of you is saying that if on a Non-B, your visa expires when the WP does, and one of you is saying that if you are on an extension of stay then that expires when the WP does. So which is it? Or is it both?

A visa entry remains valid when you lose your job, an extension of stay based on working becomes invalid when you lose your job.

If the alien granting extension of stay permit in The Kingdom for the reason of working at a business company/organization etc., resigns from such company / organization, his/her stay permit will be immediately terminated. As a consequence, The stay permit of his/her dependents will be terminated as well. Work Permit and Stay Permit must be revoked by competent officials.

An extension of stay is technically not a visa and if your working in Thailand on an extension of stay for employment, and your employment ends, you no longer have the reason to remain in Thailand and therefore have to leave the country or make alternative arrangements
