We have booked an appointment already at PEO to submit our SET-M application, after coming to end of 2 year wait under spouse visa, however I would just like to know what would happen if the application was unsuccessful? Don't get me wrong, I'd be very surprised if we did not get ILR. I just need to know what the options are. I guess appeal is the only option?

Appeal, or leave the UK.

If the application is unsuccessful then the person concerned would, I understand, be allowed to remain in the UK whilst the appeal was heard.

Unless you have reasons to doubt that the ILR application will be successful, why speak to a solicitor first?

If you have met all the criteria, and show this, then there is no reason why ILR would not be granted.

Is there something you're not telling us?

Thank you Pete and 7by7; to be clear and to close, I posted this comment so I'm prepared and understand more about the process we're going through. Yes, I'm sure we've met all the criteria. Thanks again for your comments.
