Hi all

I am asking this question on behalf of good english friend of mine.

His girlfriend is currently in england on a 6month visitors visa which expires in march, and has asked how soon she has to wait until she can apply for another visa.

Any help with this, or links to topic's on this subject will be much appreciated.

I have asked my friend to join the forum so hopefully he can help with more info.

In theory your friends girlfriend can apply for another visa at any time, but there are a number of things she needs to take into consideration when applying, the ECO certainly will when considering the application.

A visitors visa is just that, a visa designed for people who wish to visit the UK, not live there on a semi permanent basis.

Normally a person is only expected to be in the UK for a maximum of six months in a twelve month period, whilst this isn't set in law, it is a convention and an applicant will need to have compelling reasons to exceed this on a visitors visa.

You say she is in the UK on a six months visitors visa which is due to expire in March, that leads me to think that she intends to remain in the UK for the full six months, did she say in her original application that her visit was going to be for the full six months, if so what were her reasons to return?

In any subsequent application she will need to convince the ECO that it is a genuine visit and that she has compelling reasons to return, job etc. My gut feeling is that the ECO would decline a second application made quickly after a lengthy visit to the UK, believing the applicant is using the visitor visa to circumnavigate the settlement process to remain in the UK.

There is plenty of advice on this forum, far too much to provide links to, it maybe best if, as you suggest, your friend joins TV himself and has a read through and then asks any specific questions.

I know that his girlfriend has returned to Thailand for about 1 month to see her child in the period of her current visa and is now back in England.

Mabey this will show that she has reason to return.

I totaly agree that he is better to join the forum himself and search through the forum for info.
