I was born in the uk to British parents and i am 100% British, the mother is Thai and we are not currently married. My son was born in Thailand in July 2010.

I have asked several people and received varying answers.

1. Is he automatically entiltled to a UK passport

2. Do i have to apply for his British citizenship before applying for a UK passport

If you can advise it would be greatly appreciated, I would like to take him to the UK in August this year he does not yet have a Thai passport as i prefer to get the UK one first.

As you were born in the UK and your parents are British then you are British otherwise than by descent.

This means that your son is British and so you can obtain a British passport for him. However, he is British by descent and will only automatically pass his British nationality onto his children if they are born in the UK or a qualifying territory.

You may wish to register the birth at the British embassy. This is not compulsory and does not replace registration in Thailand nor their Thai birth certificate. Their Thai certificate, plus a notarized translation, should be used whenever their birth certificate is required in the UK; including in British passport applications. See How to register a birth.

You should also get him a Thai passport. He then uses his Thai passport to leave and enter Thailand and his British passport to leave and enter the UK.
