Non-M Visa Ed For Me And Child?

I am british and have a partner from Lao. My 5yr old son has a UK passport. We are currently in Bangkok on a tourist visa but I am doing a degree course which I have all the relevant paperwork to apply for an Ed visa. We are all going to Uk next month for a holiday (as long as partner gets her visa!) and while we are there I plan to go to the embassy in London and submit my application for a visa. My mother has been phoning the embassy for two days trying to get an answer to my questions and, in desperation, I am trying here as the embassy dont answer the phone. Hung on for nearly an hour or got cut off !

1. Does my son need a student visa...he is attending a school in Bangkok. They say that they cannot get him a visa and he is overstaying on his tourist one. Can he be a "dependent" as I have a visa? If he can get a visa...what paperwork should I take with me to UK so I can apply

2. I assume that my partner cannot be called dependent (although she is) as we are not married? Is there any way she can get a visa for herself as a long term visitor to my Thai sister-in-law (brothers wife) who also lives in BKK. Any ideas? Otherwise it gets costly keep sorting hers and my sons visas out.

Your Son can get 12 month extensions of stay from Immigration as he studies at a school in Thailand.

Your Girlfriend can get 12 month extensions if she is his mother and has 500,000 Baht in the bank.

If she is not his mother then she must qualify on her own merits.

I think a Triple Entry Tourist Visa will be the only option. This would give up to 9 months.

She could always enrol in a Language School and get an Ed Visa.

Your Son only qualifies as your dependant if you have a 12 month extension from Immigration.

You could also get extensions based on your Son being at school if you have 500,000 Baht in the bank.

But only one parent can get this.

You would be advised not to deal with The Embassy in London.

Contact one of the Consulates such as Hull. They will be more friendly and helpful.

BTW Children are not fined for overstay.

The 5 year old part might be the problem, sometimes immirgaiton wants a child to go to elementary school before they will issue an extension based on education. So check with immigration, if not he can be your dependent if you are the legal father.

To be a dependent your visa 9and extension of stay) together with proof you ae the father (birth certificate) shuld be enough.

Your partner can try to get a (multiple) non-O visa, based on visiting her brother in Thailand from the consulate in Hull. Longterm, she will have to wait till the child goes to elmentary school and can be his caretaker (with 500,000 in the bank in Thailand) or get an ediucaitonal visa herself.

Highly unlikely She will get a Non Imm O Visa. No harm in talking to them though.

Copies of Original Thai Marriage Certificate and Thai ID Card or Thai Passport.

If married in UK:

2) Visiting Thai child living in Thailand.

Evidence required

a Birth Certificate of child showing relationship.
b Proof of having legal custody of the child

3) Visiting non Thai family working and/or living in Thailand.

Evidence required:

a Birth/Marriage Certificate to show relationship and date of birth – applicant must not be older than 20 years.

b Letter from relative in Thailand confirming they are in Thailand together with copy of

page in their passport showing valid entry visa or a copy of their valid work permit..

Either a single or multiple entry visa can be granted to applicant aged up to 20 years in these circumstances. If applicant is aged 21 or over then they can be granted only a Tourist Visa with 1, 2 or 3 entries.

or

4) Volunteer Work.

Evidence required:

a Sponsor Letter from volunteer/charity organisation which must be registered in Thailand.

Only a single entry visa can be granted in these circumstances. Applicant will need to arrange Extension of Stay as necessary. Please check with volunteer/charity organisation

for what extra documentation may be required by Thai Immigration to extend stay.

or

5) Visiting Thailand as Pensioner aged 65 and over.

Evidence required:

a Bank Statement or Pension Statement showing receipt of State and/or Private Pension.

Either a single or multiple entry visa can be granted in these circumstances.

or

6) Visiting Thailand as Retired Person aged between 50 and 64 years

Evidence required:

Copy of Bank Statement showing income of minimum £1200 per month or lumpsum

of minimum £20,000

Either a single or multiple entry visa can be granted in these circumstances.

I see they have changed their policy regarding visiting family. So it will be a triple entry tourist visa. Would still be good for almost 9 months and when explaining the circumstances they might be lucky and get a multiple non-O, at the end of which the child should go to elementary school, giving more options.

If he gets the ED visa he could also get a non-o for his son according to 3 in LB's post.

Suspect that son is not his partners so all she could get would be the 3 entry tourist visa.

Most private schools have kindergarten which starts at age 5 or before so I would I think that his son could get an extension for going to school.

Thai Embassy is run and funded by the Thai Government.

The Hon. Consulate is run by locals and relies on income from issuing Visas for their livelihood.

You can phone Hull for advise and apply by post. Your Passports will be returned in less than a week.

If She enters on a Triple Entry Tourist Visa it will give time to sort things out.

She should also be able to get a non immigrant O visa based upon your son having one. If you have the 500K baht to put in the bank and can get your sons extension for going to school then she could get an extension of stay.

It might be advisable to try an get her a multiple entry non-o as an in case measure. If you are not sure how you are going to handle her extension.

Yes thats what we plan, (but not 500Kbaht as not got that)...multiple entry as an "insurance". Hull were very helpful.
