Hi everyone,



Has anyone ever applied for a non-imm "O" dependent visa in BK? I'm a
single parent with two kids of Thai nationality to support and I am over
50 years old. My kids were attending the same school at which I taught
for 4 years until my contract was terminated - which will come into
affect at the end of this month. I'm expecting that I will have to do a
visa run and come back on a tourist visa but if i can get a non-imm "O"
dependent visa to replace my expiring non-imm "B" visa at BK then that
would be a lot easier. Really would appreciate it if anyone has
experience or advice to share.

You as asking about being the dependent parent of Thai children? There is an option for extension of stay for a parent of a Thai child with below requirements (including being guardian and living with) but not sure immigration can provide initial O visa conversion (even wife is often only done in Bangkok):

(5) In the case of a parent, one of parents must have an average
annual income of not less than 40,000 baht per month or a
money deposit of not less than 400,000 baht for expenses within
a year.
In other necessary circumstances, The Immigration
Commissioner or Deputy of Immigration Commissioner may
approve on case to case basis.

There is a 60 day extension allowed to visit child that you might qualify for to allow more time for job search.

You should be able to use your non-b visa entry to get the extension of stay based upon having a Thai child. There is no need to do a conversion since you already have a non-immigrant visa which is all that is required.

If you were not married when the children were born you will need to get a court order giving you parental rights and custody.

Precisely what do you have?

Do you have a VISA which you recieved in a Thai consulate OUTSIDE of Thailand which is still valid (not past it's expiration date)?

Or do you have an EXTENSION to your non B visa which you recieved in Thailand based on working in Thailand?

They are two different hings, and what you need to do depends on that answer.

If you are on a non B extension, you are doing 90 day reporting, and your original visa (that you got from outside Thailand) is probably expired.

But it has been extended for 4 years based on you employment in Thailand. That is an extension based on employment and not a visa

If so, your current extension expires the day you cease working in Thailand and your employer turns in your Work Permit.

If you are married to a Thai you are eligable for a marriage extension.

If you are over 50 you can apply for a retirement extension, (but you can't work on a retirement extension).

You MAY be eligable for a 60 day extension based upon visiting your Thai wife and/or family .... but that's not gaurenteed.

Probably your best solution is to go to a neighboring country ,,,, Savannaket Laos is the current favorite.... and apply for a Non O visa based om marriage to a Thai.

You will need proof of your marriage (marriage certificate) to a Thai......and there may be some financial requirements to meet also.

But first, please specify exactly whether you have a current visa or are here on extensions of your original visa for the last 4 years (i,e do you do 90 day reporting and have a work permit?).

I'm on a non B extension which runs out on the 30th April. I think I will apply for a 60 day extension - Reason of Necessity, visiting children 2.24.

After that I will apply for the non O. I found this on thaivisa but I don't know if it still applies.

"Before it was possible to obtain a yearly extension based on the fact that you were supporting your Thai child . This was particularly useful for those who were not married to a Thai , or not over 50yrs old (to qualify for retirement extension ).

As of Oct 1st 2006 this option is no longer available.

It has been replaced as such by rule 7.17/5 This rule stipulates that a person over 50yrs of age can apply for an extension based on a Thai child supporting their parent, with no financial requirement as in other extension types.

Whilst this is bad news for those under 50yrs old, it is also good news for those over 50yrs old with a Thai child, that for some reason or other are unable to meet the financial requirements of the retirement visa , or can meet the requirements, but would rather not transfer their money into Thailand.

The downside is of course, that those under 50yrs old that are unmarried have less options now.

Immigration have been quoted as explaining that this new rule is to prevent foreigners from having children in order to stay in Thailand.

Allowing those over 50yrs old to obtain an extension based on the Thai child supporting them is in keeping with the Thai way, where the child supports the parents in their older years.

To apply for an extension using rule 7.17/5 , you will need the following documents.

Application form

Copy of the proof of relationship (Birth Certificate, or other papers issued by official organizations or government agencies

Letter from the district office confirming you are the parent.

Government fee of bt1900"

That was in the police order prior to 777/2551. The post Lopburi3 made is from 777/2551.

You will not need or get a non-o visa if you get the 60 day extension and are able to apply for the one year extension before it expires. You will still have a non immigrant visa entry that can be extended.
