thanks for all the advice guys, much appreciated. i think i have some serious thinking to do as the wife and i have been arguing all week over some petty things, and if there is a chance that she can take half of everything i own, and force me to sell the house etc, then i am starting to think i would be daft to risk it i am not sure why 7x7 stated that a pre nuptial would not be legally binding.... surely that is the point of a pre nup, that it is legally binding..... why do you think it wouldnt be binding 7x7? we would be living in a large city in UK, so my wife would make some thai friends quickly, so i think the collective knowledge mentioned earlier would soon be shared with her, and she would be aware of her rights to half my everything..... would probably lay claim to one of my kidneys too if she thought she could find use for it thumbsup.gif

Quietly square up your affairs in Thailand.

Then fly out without as much as a goodbye.

Do not subject yourself to the brain damage or worse that will follow if you tell her you want a divorce.

Just be clinical.

Square up your business.

Then leave.

A pre-nup is simply not legally binding under UK law, although the High Court is changing its position on this. But new rules haven't been worked out yet.

Half of everything is often not the case, but not sure about UK-law on this. Often you share/split gains and losses made during the marriage and not what you had before.

Half of everything is often not the case, but not sure about UK-law on this. Often you share/split gains and losses made during the marriage and not what you had before.

UK law is a hard one to fathom, mainly because divorce is handled in 'family court'.

'Family court' doesn't work under the same rules as the normal court, no rules of evidence at all.

All works on hearsay, presidence and unpublicised rules, often held in secret.

If a divorce were held where one partner were a foreigner claiming protection from domestic violence I can only imagine the outcome would be along these lines.

1) All costs would be down to sponsor (no recourse to public funds).

2) All living expenses down to sponsor (sponsor signed a contract along these lines)

3) Automatic right to citizenship (special rules to protect women from violence)

4) Lifetime accommodation provided by sponsor (she gets the house)

I wouldn't want to be the sponsor (husband) in this situation.

Really hard to give accurate advice as British family court is so secretive.

Of course the violence accusations don't need proof in family court but do need proof in criminal court.

So you can get the strange situation where the man loses everything (financially and personally) in family court but has no exposure to personal risk (jail or sentencing) in criminal court.

A pre nup is not legally binding in the UK because the law says it isn't. The UK is not the USA.

Whether this will change, I don't know.

The point of having one?

As I said, although it is not legally binding the court can, and often does, take it into consideration when setting maintenance orders and the division of assets.

Other than that; no point at all.

Your assessment of what would happen if the immigrant spouse of a British citizen claimed domestic abuse/violence is not correct.

The issue of costs, maintenance and division of assets in any divorce would be down to the court.

If the foreign spouse did not already have Indefinite Leave to Remain, they could apply for it under the domestic violence rules. You will see that an accusation of domestic violence is not enough; proof is required.

There would be no automatic grant of citizenship; if they did not already have it then they would have to apply in the usual way and satisfy the standard requirements.

Not sure how we got onto discussing domestic violence, anyway. There is certainly, I trust, no assumption by anyone that the OP would commit such a foul act!

Those who may think that once in the UK his wife may claim it as a means of remaining will see from the link above that claiming it is not enough, proof is required.

if you are planning to move to the UK together, that will be a big step for her. Might be better to first work out your marital problems before adding stress of moving to another country.

if your lady give you her heart, she give you her trust also

she will follow you most place if you take good care of her

but if she have black heart or heart not with you, then maybe you have problem, yes

better to make sure where her heart is first before make big decision

there are so many people giving you good advice.

all i will say is my so called marriage lasted exactly 4 years.It didn't matter what she had done I think i was lucky it cost me over £50,000

Read this again. Quite clearly you would be mental to even contemplate letting her set foot on your home soil the way things are now.

Possibly bring her on a tourist visa not a spouse visa, a lot cheaper and easier to get, and she would have to leave at best/worst in six months

she would find it hard to pursue a divorce in the UK from Thailand

just a thought I'm not a legal eagle so up to you to choose if it's good advice or not

ta for the advice guys, and obviously not coming to england, i realise, is one option, but we want to give it a go,

i am just a bit worried

if we were in the UK, could she divorce me there and gain access to half my UK house etc? if so, is there anything we can do before we go to ensure that she would not be able to lay claim to half my assets?

If the answer is so important to you, how about contacting a UK divorce lawyer, give them a brief without the emotional content & ask them the cost for a formal written/email response.

Calling her TEE RAK your screwed already .....no Thai women calls their other half TEE RAK .....now how to take to UK ....are you for real look at your post it's over !!!!
