Lets face it, as pathetic as this is, Tarit has to try every single thing that he can, because nobody working for the current administration has burned more of their own personal bridges than Tarit. He knows that if this Government fails, he cannot stay in Thailand as he is quite rightly, a marked man. The funny thing is, he probably believes that Thaksin cares for him. He is nothing more than cannon fodder and is nothing but an expendable 'doer' for Thaksin, and when you consider how disposable the top right hand General was in 2010, then Tarit must know he is in the middle of a very large lake, with very thin ice.

"The warning of criminal litigation against whistle blowers was issued Monday by the DSI chief. He said that the whistle blowers would be deemed committing an offence against Section 370 of the Criminal Code for causing noise unreasonably and against Section 397 of the same code for bullying or for putting someone to shame."

Oh you sad, sad little man (the second). What is it about these whistles that turn grown men into pathetic whining sad sacks? Could it be they are striking a cord. The bells of hell may go tingalingaling but the sound of a fear appears to be a shrill whistle.

Im all for it, if it can get rid of the parking lot whistle blowers!

Agreed on the point of these parking wallers, but it is about something much more important than your personal feelings.

Yes it's about, er, what is it about again? Oh yeah Sutheps going to bring down the government by whistling, or something.

Well. People in high places seem to be getting upset about the whistling so something is working with the "childish idea"

Hey, if making excessive sound that invades petioles peoples privacy is illegal, I'm all for it.

Lol.

How the hell does he plan to create a law like this?

Read the OP. It already exists "Section 370 of the Criminal Code for causing noise unreasonably" coffee1.gif

There are many for feel that the blowing of a whistle to rid the country of the current idiots including the fugitive overseas caddy is not unreasonable noise, therefore this would need to be ruled on in law to define what is unreasonable. Just because Tarit say's it's unreasonable doesn't make it so.

That's a fair point. Has causing a noise unreasonably been defined ? Tarit would have to investigate and if someone blew a whistle at him. then he could ask the DSI to charge them because he, has the recipient of the whistle blowing, deemed it an unreasonably caused noise. The file would then be passed to his boss, the very unbiased non-political law enforcing AG, who would have to decide, based on the evidence and the law, if a prosecution should be bought brought. It would then be up to the court to decide if, based on the evidence and applying the applicable law, a noise had been caused unreasonably.

I wonder if the heads of the FBI, AFP, Metropolitan Police, Surete etc would also react so positively to such a dastardly threat ?

Love the bit where he warns his own DSI people not to do it against their superiors !! Must be great leadership at the DSI !!!

But on what charge? Noise pollution? or what else is there to charge people with?

And charge of noise pollution is punishable by how much? 500 baht?

If one pleads not guilty, how would DSI prove in court the noise from the whistle was above the acceptable level? Are they going to carry the instrument to measure each whistle?

Seems the whole regime is starting to go little silly

no mention of blaring loud speakers used by the red shirts during their rallies.

I hope no more whistles for every parking attendant or one that waves cars on

into the road. I had never seen nor heard so many whistles in my life until I came to Thailand,

it's a tool for almost every trade it seems.

" Arresting people for causing noise unreasonably " in this case they should have arrested

99% of the people in Thailand, as the unreasonably noise level is everywhere, from building

sites to late night entertainment venues,,

Meanwhile as reported elsewhere :

The red group community radio for democracy will rally at the house of every constitution court judge if they don't like the way the court rules.

But that's not threatening or intimidating so no need for Tarit to get involved.

Bloody losers these DSI. If there's ever a coup and the military takes over, Thaksin paid Tarit and his cronies should be the first fired.

I would suggest that Tarit will face greater difficulties than being fired. His performance over the past few months brings his judgement into question, and indeed, some of his actions may be deemed to be illegal, leading to successful lawsuits against him.

I look forward to the day that he has to face the music, but of course, he will probably take a visit to the Olympics like his great friend, and never come back...!

The post is missing some interesting facts:

DSI director-general Tarit Pengdith said he would take legal action because unjustified causing of loud noise was a criminal offence as per Article 370 of the Penal Code.
If found guilty, an offender faces a fine of up to Bt100.
Whistle-blowing protesters might also face a charge of humiliating others in public. The offence is punishable by a jail term of no more than one month and a fine of up to Bt1,000.

Sorry to repeat myself but this is the law, while you a Thai gets 500Bt for an attack with a knife? Who are these idiots in charge to specify punishments in this country?

Btw I am writing this while a Thai in religious delusion is screaming for hours in front of my house for the second consequent day...

BANGKOK: -- Protesters who blow whistles against any officials of the Department of Special Investigation or their chief, Tarit Pengdit, may face legal actions.

What a sad little boy this Tarit creature is, its seems as if i the creature is labouing under the delusion that he can rule by personal decree. Indeed another twisted little mind so beloved by Thaksin his family and their brown nosing acolytes.

Never mind Tarit when you and your ego arrive at your office tomorrow you can play with your whistle.

To ensure your personal satisfaction remember to change your operating standards after 99 blows of your whistle.so as to ensure you don't come to a sad end.whistling.gif

Punishment for the crime................ public spankng over his knee before dismissal.

...causing noise unreasonably and against Section 397 of the same code for bullying or for putting someone to shame.

I think that this DSI guy should be charged under section 397 for bullying and putting HIMSELF to shame. He is acting like a little girl.

UPDATE:
Furious DSI chief warns whistle blowers

By English News

BANGKOK, Nov 19 – The top Department of Special Investigation (DSI) official has threatened to take legal action against people blowing whistles to protest or chasing senior government officials.

DSI Director General Tarit Pengdith said whistle blowers are liable to charges of creating annoyance and causing shame to other people.

His statement was retaliation to former Democrat MP Suthep Thaugsuban who told anti-government protesters to blow whistles at senior government officials as a display of civil disobedience.

Mr Tarit was among senior officials at whom people blew whistles. Two others were Education Minister Chaturon Chaisaeng and Deputy Prime Minister Plodprasop Suraswadi.

The DSI chief said blowing whistles is a violation of the Criminal Code for causing disturbance and shame – an act liable to a maximum one-month jail term or a fine at not over Bt1,000, or both.

He said Mr Suthep’s action stemmed from his anger against the DSI which is taking legal action against him in several cases.

DSI officials were instructed to take photos of whistleblowers so as to take action against them, he said. (MCOT online news)
