hello,

just a quicky, ive tried for the last 20 mins to find on the web site but no luck. Anyway...........

i have a non imm b visa due to expire on 21/5/06. it's now too late to apply for the work permit so.....

1) can i extend the visa by say 10 days or a month or something, then get the work permit, and take it from there?

2) if not where is best to go to obtain another? i'm in bkk now. i guess my options are siam reap, pp, kl, singapore. any advice?

3) do i have to go out of asia to get the imm b visa?

Are you planning on doing a extension of stay based on business? If so, you do not need to leave Thailand and can still apply for your work permit .

You then go to Immigration show your work permit pick up date receipt and get a 30 day "under consideration"

You then get a work permit for that time.

End of the 30 days.

Repeat these steps till you get the one year.

If you are not planning on doing the extension of stay, still apply before Friday for the work permit as in Penang, sometimes they will give a one year multi entry visa with this receipt.

The work permit will not be valid when you go to pick it up but several hours later it will be when its been revalidated with the fresh 90 day stamp. You will need to pay 850 in government fees twice.

although i'm a little confused with what "based on business" means. i want to extend the imm b visa so i can get the work permit and then start working. does this qualify?

Extension of stay based on business is a long term visa where you are able to live in Thailand without doing a visa run. The requirements are the employer must employ 4 Thai employees per work permit (1 Thai employee if the companies business objective is Consultant or agent) The Thai employees must get a minimum salary of 5,250 Baht per month and you must be getting a minimum salary such as a European being 50,000 Baht per month. You also must have a work permit.

If you cannot meet the criteria, then you can do a 90 day visa run on a one year multi entry visa. Then your employer does not have to have 4 Thais employed to hire you, pay you the minimum of 50K per month if you are European but you still qualify for having a work permit, if the company has register capital of 2 million Baht per foreigner ( 1 million Baht if you are married to a Thai) and you have a non immigrant visa.

Spurs, if your non-B visa was for a single entry, it lost its validity when your entered Thailand with it. If the visa is valid for multiple entries it remains valid for entries into Thailand until the expiration date indicated on the visa, regardless of your job termination. In either case, after terminating your employment, you are allowed to stay until the date indicated in your entry stamp (admitted until <date>) in your passport.

After the termination of your employment, your employer must inform the Labour Department (LD) accordingly, I believe within 15 days.

I don’t know what happens to the work permit book. I have seen posts saying that it must be returned to the LD. I can imagine that it would certainly have to be presented to the LD for the cancellation of the work permit, at which time you could ask them if you can keep it for the work permit with your next employer to be entered in the same book.

I think I might be getting some bad guidance from my lawyer based on what Sunbelt said above. Perhaps I should be switching to Sunbelt :o

My situation:

- I have a 1 year multi-entry Non-Imm "B" visa

- I have a work permit

- My company has the minimum capital requirements (2 million baht for each foreigner employed)

- Every foreigner is paid above the minimum salary (50,000 baht per month)

- The company has over 4 thai employees for every foreigner employed. Thai employees are all receiving well above the minimum 5,250 baht.

My 3 months is about to end, and I've been told that I CANNOT get an extension at immigration because:

Company's stated profit from LAST year (new company) is not sufficient to cover all employees salaries for a full year this year. Thus I'm told I have to make a visa run.

Is this true? I would much prefer to just get the extension at immigration of course.
