Court rejects DSI’s request for arrest warrants for 35 PDRC core members

BANGKOK: -- The Criminal Court has rejected the request of the Department of Special Investigation for the arrest of 35 key members of the People’s Democratic Reform Committee.

The DSI, represented by Pol Maj Yutthana Phraedum, on Thursday asked the court to issue warrants for the arrest of the 35 PDRC’s core members claiming that they had refused to answer summonses to show up at the DSI to acknowledge the charges against them and, moreover, continue to commit offences.

The court rejected the request for arrest warrants but suggested the DSI to issue another summonses for the 35 suspects reasoning that they are ready to give testimonies to the DSI officials and have no intention to escape.

Pol Maj Yutthana said he would consider issuing summonses tomorrow. He disclosed that some of the suspects claimed they had not received the summonses because there were at the protest site.

As for the third-tier leadership of the PDRC, the officer said he would be able to identify them and to determine what additional charges would be lodged against them Friday.

The right to protest is a perceived human right arising out of a number of recognized human rights. While no human rights instrument or national constitution grants the absolute right to protest, such a right to protest may be a manifestation of the right to freedom of assembly, the right to freedom of association, and the right to freedom of speech.

"democracy" as referring to a system involving multiparty elections, representative government, and freedom of speech,

Quiet frankly this DSI is on another planet, you wouldn't believe the hide this crowd have , I would be shutting up DSI , till , like you always do, see which way the pendulum is swinging, maybe , just maybe in the months to come you could be standing in the unemployment line with charges of abuse of power charges aimed at you from Mr Suthep.bah.gif

Not enough. Somebody must be held accountable for the rice scam that has cost the taxpayers 800 billion to date and still no money to pay the farmers.

There are already enough arrest warrants issued that are not being acted on. Why issue more.

How about getting that hit and run cop killer to show up for an arraignment? It was reported in this newspaper that the police had served three warrants for his arrest and he failed to show each time. This is a big problem for legal reform in Thailand Privileged evasion of law and order with impunity. Thailand will never change and there will never be peace without legal enforcement regardless of pecking order.

Maybe the cop claimed to be PDRC and needed to be free so he can continue to break the law.

Interesting court decisions. No cited reasons for the rejection, although this may be an oversight by the reporter and not the court. So if the accused are not ready, does DSI continue issuing summones until the accused decide they are ready? Like next year.

There are already enough arrest warrants issued that are not being acted on. Why issue more.

That's the whole point, and you're missing it, arrest warrants have not been issued. Summonses for them to acknowledge various charges have been sent to some individuals and if they do not comply with the summonses arrest warrants can then be issued if the court thinks it's appropriate.

Perhaps Chalerm should personally deliver the summonses himself to the protest leaders. After all, he's thrown himself fearlessly into the mix.

Posts criticising court judges removed. From Thailand Penal Code:

Title III, Chapter 1, Section 198: Whoever, insulting the Court or the judge in the trial or adjudication of the case, or obstructing the trial or adjudication of the Court, shall be punished with imprisonment of one to seven years or fined of two thousand to fourteen thousand Baht, or both.

Great set of points. It's good to see DSI being reeled in every so often irrespective if only over minor points however Tarit is unlikely to get the message as he's so much of a sycophant that he only hears HMV.

Yet more evidence that you make things up. Few if any posters have suggested that & I certainly haven't seen 'many'..

However there was one instance where it could be justifiably said: when Sanoh & Pojamin organised & 'influenced' respectively the judges in Thaksin's assets scrutiny fiasco. Episode one in the Thai dynasty serial.

Yes along with YS and all 380 officials.

Does that mean Charlerm still can not keep his word to capture Suthep. Poor Charlem, he didn't cut his head off and now can't even catch Suthep. This guy hasn't kept his word yet...oh....he never did.

Lack of evidence ?

Hmm. OK so you set up stages all around town, on busy roads and stuff.

Then theres an emergency decree that tells you that you cannot be in a group > 5 people in designated areas, some of them where these stages are. Then you go on stage, on camer and defy it all.

What more evidence did they hope to see ?

Just a thought

Freedom of speech is an American concept that has never been a part of Thai constitution and even some first world countries where you would not have suspected it have no freedom of speech. Singapore for example.

And let's not confuse the right to protest with a right to attack people at polling booths, set up 12 meter tall loudspeakers outside people's homes, give hate speeches every afternoon until 1am in the morning and block traffic or occupy airports.

Mind you, I see the PRDC's points. Just the methods need refinement. On the other hand, do normal tactics work in Thailand ? No. #ihavenosolutioneither
