Hi all

I've had a read through many threads on here but can't seem to find one that fits!

My wife (Australian O-visa but switching to F-visa in March) and I (British on a B-visa) have just had a child here in Thailand. We have been living and working here for 3.5 years. Our baby is now 5 weeks old and has just obtained her Australian passport. My colleagues who normally arrange my visa have been doing their best to help but this one seems to be outside their area of expertise. We plan to travel to Phnom Penh in early March since my wife will need to switch visas at that point and needs to leave the country.

Any help would be gratefully appreciated:

- We believe that we need to exit the country and then re-enter to get a visa stamp for our baby. It appears that at that point, she can obtain a dependency visa from within Thailand. Is this correct? Or should we be aiming to get an O-visa for her when we travel to Cambodia?

- When leaving Thailand for the first time, will we need any special letter since she is technically here illegally at the moment? Afterall, she just got her passport and has no visa to reside in Thailand!

- Is there any way of making her residency here in Thailand legal without leaving the country?

- Has anyone been in this situation before and is able to explain what they did about it?

Thanks so much in advance for your help. We're a bit lost! All our friends with young kids are either Thai or have Thai partners so their kids are Thai.

When leaving the country with the baby you will just need their birth certificate and passport.

If you are on extensions of stay (it is not a visa) you obtained from immigration you should get a non-o visa based upon your extension for the baby. You will need the birth certificate and copies of it your passport photo page and extension of stay stamp. Then after returning get an extension for them as your dependent.

You will not be able to do a conversion to a non immigrant visa for a dependent extension at immigration.

Are you aware that Phnom Penh takes up to 4 days to get the visa and is known to be unfriendly at times for getting visas. Other locations are next day service for visas.

1 parent needs to be Thai.

Similar to giving birth in an airport.

Since no overstay is charged on children under a certain age, is it necessary for your newborn to do a visa run?

It is always better to get the proper visa or extension of stay if they plan on staying here long term.

Although children under the age of 15 do not pay an overstay fine it is still recorded as an overstay.

I would have thought taking a newborn child on 2 flights and staying at a hotel in Cambodia or Laos for 2 to 4 nights would not be worth the stress for something that makes no difference at all and can be done when it is necessary to fly the child out of Thailand.

Just my opinion.

I based my suggestion upon the OP because they are planning a trip out of the country any way. I am sure they will be taking the baby anyway.

Additional info to the OP. Your wife should not need to leave the country if she already has an extension of stay as your dependent (not an O visa) she should be able to change the reason for her extension to performing official duties (category non-f visa) the rules for extensions of stay only state an applicant needs a non immigrant visa.and does not specify a category of visa.

Thanks for the tip! It would be great if my wife can just do the non-imm F visa here without having to do it in Cambodia. At this point, it looks like we will just go on the trip as normal (we are due to be in Phnom Penh for a weekend). My wife will go on her usual non-O and then hopefully we can get the non-F sorted when we get back.

You've mentioned about 'extensions of stay' which I'm a bit confused about. Does our daughter need a non-O visa obtained in another country or can she just come back in on ours? Is it possible to arrange something in Bangkok before we leave? If not, on our return would she be stamped in on a usual 30 day tourist stamp and then overstay but not be charged? It would be difficult if we came back and landed at Don Mueang only to be told that our daughter can't come back into the country with us!

We won't be in Phnom Penh for the four days you suggested it would take to get an O-visa processed so this is a bit complicated. Cancelling the trip is an option but it would be a shame to do so.

Your wife will non get a visa here she would get an extension of stay if she has the proper paperwork. I am assuming she already has an extension of stay as your dependent not a non-o visa from an embassy or consulate which also means I assume you have an extension of stay obtained at immigration not a visa.

Your daughter will get a 30 day visa exempt entry unless she gets a visa.
