Between Jobs: switching non-b visas. How do I do it?

Featured Replies

I still have a work permit and extension of stay with my old job. These expire on October 31st, My new job told me to leave the country, obtain a tourist visa, come back to Thailand for 1 day, then back across to get a new Non-B.
1. Can I even leave the country if I have an extension of stay which hasn't expired?
2. Is that the easiest way to go about this or is there an easier option?
Thanks

If you have left the job and the old company has informed immigration and your on an extension of stay you may in fact be on an over stay right now

They haven't informed immigration yet. They said they will do so on Monday

I think if you end your relationship with your old employer then under the non-B visa regimen you are in fact on overstay unless you extend that Visa for 7 days in order for you to get your affairs in order.

The experts will be along shortly who may rubbish what i say but I do believe that a trip outside Thailand to get a new Non-B under your new employers sponsorship may be required.

Maybe some info like "Does the old job and new job involve the same labour office" might be relevant.

I'm sure many people change jobs, and it would seem unfair even by Thai Standards to force you out of the country to do that.

Well if your on an extension of stay post Monday you will be on an overstay if you don't get a 7 day extension and make plans to leave Thailand

Basically, I'm still employed by the first place. I told them I was moving and they gave me a week before cancelling the work permit. Its in the same town, same labour office.

Technically speaking if he is on an extension of stay he doesn't really have a b visa anyway, so the non imm b bit is somewhat irrelevant

Im going to Laos on Monday. The question is: What happens when I try to leave the country if I leave without having a cancelled work permit and extension of stay? Also, is it possible to switch from non-B to non-B in Laos or do I have to do a bit of messing around with tourist visas etc

You need to go to immigration with a letter from company stating the date you job ends and cancel your extension of stay before leaving the country.

I am sure you no longer have a valid B visa it probably was a single entry that became invalid on the day you entered the country.

You will need to get a tourist visa and apply for a new work permit and then go out for new non-b visa showing the letter of approval for your application from the work permit office in order to get the visa.

As already posted, you are on an extension of permission stay based on employment in Thailand, not a non immigrant 'b' visa entry.

If you try to leave Thailand without a Re- entry Permit then there may be problems as it's not difficult for them to figure out that you have left your employment.

Once your WP is cancelled, you should do the following:

1) Cancel your currrent extension at your local immigration dept then get a 7 day extension.

2) Get your new employer to apply for your new WP using form WP1 attached below (form for those already in Thailand).

3) Once you have a receipt for successful filing of your WP application, go outside of Thailand to apply for a Single entry non immigrant 'b' visa- see link below.

http://www.mfa.go.th/main/en/services/123/15388-Non-Immigrant-Visa-%22B%22-(for-Business-and.html

4) Re-enter Thailand get a new 90 day non 'b' stamp, use this to collect your new WP then start work with your new employer.

If you are a teacher, then the procedures are different.

Since the OP mentioned Laos it would best that he have a look at the requirements here on Vientiane embassy website. http://vientiane.thaiembassy.org/vientiane/en/consular/consular_check/

It states a letter of approval must be presented not just the receipt for the work permit application. There have been reports that they are firm on this requirement and people have not been allowed to make the application without one.

Penang also currently look for the Letter of Approval; it can be obtained from Labour once a successful WP application is filed, awaiting a valid Non immigrant' B' 90 day passport stamp.

The Letter of Approval can take a few days to obtain as is requires a department head's signature, this is another reason why the OP needs a 7 day extension.

Go see your local Immigration than you know what you have to do for sure !

Not sure whether this could apply to the Op or not but this issue of extension of stay finishing the same day a job finishes come up often.

So long as their employer was cooperative, is there any reason why an employee couldn't take their outstanding vacation from the day they finish actual work and have the letter of termination dated for the day their vacation runs out?

Unless an employer was vindictive I don't see why they wouldn't cooperate with that.
