Non O multiple or one year residency?

Hi all, I've been browsing the forum quite a while but I just joined so hola to all :)

I am married to a Thai national (marriage in Malta my home country) and I had no trouble obtaining a non o multiple entry there before I came to Thailand April 2013. I did my run every 90 days and now have my last 3 months before my visa expires. From what I have gathered from the info on here is that now I have two options. Either going out to a neighboring country and obtaining another non immigrant o visa (for which I will have to do border runs every 90 days) Or applying for an extension of stay (1 year) for which I won't need to go out every 90 days.

My marriage document is in both english and maltese. Do i have to translate it to thai? Also i have to show 400000 baht in bank or proof of 40000 baht income every month. I rent out property inmy country so have my income from there every month. Would a Bank statement for the last year be enough to show? I also bought a motorbike and car (in my wife's name) and pay each month for both. Would these slips help? 400k in the bank is out of the question so maybe I'll have to opt for the non o visa.

I live near chayiaphum but I don't know if they have an immigration office or not. Is Korat the nearest city which I can go?

You will need to register your marriage at the Amphoe in order to get an extension of stay.

You would need to have the marriage certified by your embassy or consulate (can be done by way of an affidavit or statement stating it is true and corrector) and then have the marriage certificate (and certification) translated to Thai and the translation certified by the Ministry of Foreign Affairs (translation service can get this done). The you go to the Amphoe to register the marriage. They will update your wife's house book and will issue her a new ID card and give you a Kor Ror 22 marriage registry. When you apply for the extension you will need the Kor Ror 22 and a your marriage certificate.

To prove your 40k baht income you will need a income letter from your embassy.

Khon Kaen immigration is the assigned office for Chaiyaphum province.

Hi joe thanks for your swift reply. Malta doesnt have neither an embassy nor a consulate in Thailand. I know this because when I applied for a holiday visa for my wife I had to go through the Austrian embassy in order to obtain a schengen visa. Where should I get my marriage certificate certified. Would the Thai consulate in Malta be any help?

They should be able to witness a affidavit, statement, declaration or whatever they call it that you sign stating it is a legit document.

It could be done the same way for your income proof. You could do it at the same time you do the other one since they are valid for 6 months.

Hi there guys, I have a few more questions and am grateful for anyone who inputs their thoughts.

Regarding proof of income, I have emailed a bank statement for the last year from my bank in my home country, certified by an attorney to the maltese consulate in Bangkok. I am waiting for their reply. Do you think it should be enough? The total amount deposited throughout the year was about 800000 baht.

Regarding my Maltese marriage certificate, I went to the local amphoe with an original document to see how to register it and the person working there told me that I don't have to certify it with my consulate, but I have to have it translated to Thai and certified by the thai foreign minister's office in bangkok. Also that I have to go in person for this stamp. Now my marriage certficate has two languages on it, Maltese and English. I read somewhere on a list of requirements that if it is in English, I Do not have to translate it to Thai but it must be certified by my consulate and tht would be enough to register. If someone has registered a foreign marriage certificate in their local amphoe I would appreciate their help because the lady t the amphoe didn't seem to know what she was talking about. I also would like to know what the form khoror22 is about and If I can download it from somewhere.

One last question. Before I said I lived in Chayiaphum area. Although the city is only 30 mins away,my wife informed me that our town kaeng sanam nang is part of Nakhon Ratchasima and not chayiaphum. So I would presume I would have to go to korat city and not khon kaen to apply for my extension.

To register the marriage at the Amphoe it must be translated to Thai and the translation certified by the MFA. You do not need to be present for this. Most translation services can get the certification done for an additional fee.

If you look at my previous post I wrote that you needed to have it translated.

Hi ubonjoe just a quick question,

My consulate has returned bank statement and marriage certificate all stamped, verified and good to go but did not provide a letter as a proof of income. Will the certified statement be enough or shall I contact the consulate again for a letter.

If they go through the statement it's obvious from the deposits made monthly that the income is sufficient but I want to be sure I have everything correct before going to the immigration.

You are still going to need the marriage certificate translated and certified before going to the Amphoe,

You will need a letter or some other document on consulate letterhead for immigration. A stamped account statement will not be enough.

Hi joe thanks. Yes i translated and certified the marriage certificate and am waiting for it, should arrive tomorrow or next day.

when I asked the consul for a letter stating that my income is sufficient this is what he replied

My email

Dear sir,

I received my marriage certificate and statement all stamped for which I thank you. However I have checked with Thai Immigration Office and I need a letter from my consulate (on consulate letterhead paper) stating that my income is equivalent and more than 40000 baht every month. This letter has to be signed and stamped.

His response

I have already certify your yearly income from a rental property in Malta. There is no another further to verify your income as your required. You can show to the Thai Immigration of as wishes. However if you wish to your verify is income again you have to ask MFA to verify you first and notify by Notary Bublic for your verify here again!

I'm lost as what to do more.. He is Thai and his English as you can see isn't that good. This is why I emailed him as over the phone a conversation is impossible.

I am in the process of getting an affidavit proving my income from my country which will be stamped by a local notary. If then the consul stamps this will this be enough for immigration along with the statement?
