I have a friend who has finished his contract with his old school. Hasn't gone with them to immigration to cancel the work permit and wants to just leave the country, get a tourist visa and then apply for a new work permit with his new school. Is this possible? Does leaving the country void everything previously done?

Or if he does a border run will it not void anything. Eg: will he have to still go and cancel the old work permit to get a new one for the new job?

Apologies, I couldn't find this exact answer in the old threads. Kind of urgent too. Hope you can help me TV.

Possible, but could come back to bite him. They might ask him when he leaves the country why he doesn't get a re-entry permit if his permission to stay is still valid and when he applies for a new work permit they very well might ask and check about his current WP and find out he didn't cancel his WP.

He should cancel his permission to stay if on an extension, after having his WP cancelled at labour with a letter from his current employer stating his last day of employment.

If the WP is valid till last day of employment, it doesn't need to be cancelled. If his extension to stay is valid till the last day of employment, he doesn't need to cancel that one.

He is now in Bangkok, old work permit is from Nan. His old school is saying he has to go to the Nan office to cancel it, then leave the country and apply for a tourist visa, then get the documents for a new work permit/non b and do another border run.

This is the main issue. Does he really have to travel all the way up there?

No the employer can do it alone. All it takes is for them to fill in a form.

I know this might sound like I'm asking for me but I promise I'm not. :)

Anyway, thanks for the answer. Seems like his old agency is just trying to make him do it all as they are lazy and he isn't working with them anymore. So to confirm, he needs the agency to get his old school to fill out this form. Then this cancels the work permit. I assume this kicks in the 7 days to leave the country also?

Anyone know what form this is? TM??.

The employer can cancel the work permit withou you or th actual work permit itself, but the empoyer can not cancel your permisison to stay from immigration. For that you will have to visit Nan-immigraiton in person yourself.

The 7 day "extension" requires the same form as any other extension.

I was told that you have to cancell your work permit before you can apply for a new one, so this is what happened to me and how it worked.

1. Got a letter from my old school to say my contract had expired and that I was no longer employed by them.

2. Got a contract and other non B documents from my new school

3. Went to the Labor office to cancel my old work permit

4. They asked if I was leaving the country or going to a new school

5. They went away for ten minutes or so and then came back and asked when I was going for my Non B which was three days later. They explained my visa would expire at the end of that day so I would have to leave that day or get a seven day extension.

6. A few minutes later a man returned with two letters a) A letter for the consulate confirming that I had cancelled my work permit and and was eligible to apply for a new one to work at my new school. B) A letter for the school that basically said the same plus that the school should attend with me on my return to pick up the new one, a list of the usual documents, confirmation from my old school of end of contract and that they should provide this as a letter of proof that I had canceled the old one and was eligble for a new one.

7. They kindly dated the documents the day of my departure to Laos which saved a seven day extension or overstay.

8. Went to Savanaket, stood in line for ten minutes, the guy looked at the first document from the dept. Education and said pick up your passport tomorrow.

When I got my original work permit it took hours of stuffing around because I didnt have a degree, not sure how it was resolved but I got it in the end. Apparently, this time its not an issue because I'm going to a private Prathom school and will be granted a waver.

Easy really, compared to Vientiene, Savanaket was a breeze.
