BANGKOK: -- The Constitutional Court on Wednesday dismissed caretaker Prime Minister Yingluck Shinawatra from office, ruling that she abused her power by transferring National Security Council Thawil Pliensri.

The nine Cabinet members involved in the unlawful transfer of Thawil were stripped of their positions. "The Prime Minister's status has ended, Yingluck can no longer stay in her position acting as caretaker prime minister," a judge said in a live televised ruling.

The remainder of the cabinet can continue working, the judge said. The judge said Yingluck violated the charter on the transfer of Thawil from position of National Security Council.

The transfer of Thawil Pliensri from the post of National Security Council chief was unlawful, unconstitutional and unethical.

Yingluck Shinawatra had a hidden agenda in ordering the transfer and also intended to benefit a relative. The court thus ruled that the transfer was prohibited by the law as it was unethical and a conflict of interest.

The Court ruled that only Yingluck and nine other Cabinet members who took part in Thawil's transfer must be removed from the Cabinet.

The others, who were not members of the Yingluck Cabinet that approved Thawil’s transfer, can remain in office as caretaker Cabinet members. The court also ruled that the caretaker Cabinet can continue its duties until the new Cabinet takes office.

The Constitutional Court ruled that it has no mandate to order the appointment of a new prime minister within seven days as requested by the complainant.

The request to the court to order the appointment of a new was made by Senator Paibul Nititawan during the trial on Tuesday. Paibul filed the abuse of power suit against Yingluck.

Incorrect it does matter...another group of Thaksin criminals were removed from office legally. The remaining PTP members including the next Thaksin clone leading them will have the same fate if they do not follow the rule of law and constitution. The courts this time around are showing they have the balls to rule. A good day forward for the rule of law in Thailand.

The outcome was predetermined at the time the illegal action took place. How could there be any different outcome if the court rules according to the law? The unanimous 9 to 0 decision sounds pretty legal, as did the surprise hard evidence of who was involved. They got caught.

BANGKOK, 7 May 2014 (NNT) – The Constitutional Court has unanimously ruled to remove Prime Minister Yingluck Shinawatra from her office after she was found guilty of illegally transferring the National Security Council (NSC) chief Thawin Pliensri.

The court delivered a verdict to remove Ms. Yingluck and nine other ministers who approved the transfer of Mr. Thawin of having abused their power. As a result, all ten of them were removed from their posts.

The nine ministers include Surapong Tovichakchaikul, Chalerm Yubumrung, Kittiratt Na-Ranong, Santi Prompan, Anudith Nakornthap, Siriwat Kachornprasart, Pracha Promnok, Yutthasak Sasriprapa and Plodprasop Suraswadi.

The ruling echoed that of Supreme Administrative Court, which said the transfer had been unlawful and unfair because Ms. Yingluck had not given appropriate reasons for the NSC chief’s removal.

The case was filed by a group of senators led by appointed senator Paiboon Nititawan, who insisted the premier gave the green light for the transfer to benefit her own political party.

After Ms. Yingluck was dismissed, a deputy prime minister from the Pheu Thai Party would be replacing her role as caretaker prime minister. Two deputy Prime Ministers who did not attend the cabinet meeting at the center of the trial are Niwatthamrong Boonsongpaisal and Pongthep Thepkanchana.

He achieved plenty, lunatic or not. he stirred up underlying emotions and brought them forth on to the streets. despite the fact his physical numbers have dwindled, the emotions of those who supported him (whether they still support of not) are still very much against Thaksin. Open and shut situation that any other ruling would have been a mockery of justice. The removal of the others involved will go a long way to cleanse this party of parasites who have operated in their posts for favor and profit as individuals with total disregard to their responsibilities to the Thai nation. It should be remembered that this ruling constitutes a dishonorable discharge from duty. They have been weighed,they have been measured and they have been found wanting.

Yingluck Shinawatra, who has been removed as the prime minister by the Constitutional Court, would not come out to talk to the media Wednesday, a source close to her said.
