Having a Work Permit, doing some consultant work on the sideline

Featured Replies

Dear Sirs,

I'm having a question. I have a Work Permit in a hotel in BKK and plan to do some consultant work for exporting staff to the Western World, "on the sideline".

My question is, am I covered with my WP, or how dangerous is that for me?

A quick advice would he highly appreciated.

Best regards,

Landibkk

Your work permit covers you only for the work you do for the employer indicated in your work permit.

The single biggest problem in communication is the illusion that it has taken place

Read the back pages of your WP, they are in English..

That pretty much sums up the max penalties you could face..

I am not going into detail on here cos it will be shot down by people that have no idea what they are talking about..

Be very careful as in addition to what's on your WP, your existing employer could also fire you for "moon lighting"

In theory a work permit is so specific about the location and character of the work to be done that it's useless. In reality it doesn't matter to much unless someone has it in for you big time.

Knew it wouldn't be long before someone said jail, LOL

I've scanned the back of my work permit, the penalty is max 20K fine and possible forfeit of the work permit.

Breaching terms of work permit is not the same as NOT HAVING A WORK PERMIT

You could argue that. If you do work other than what is described on the permit, you are doing work for which you don't have a permit. So the punishment could be the same as not having a permit at all (for that specific work).

Err no....

Think of it this way in most western countries...you have a legal driving license and exceed the speed limit get caught...you get a fine (slap on the wrist

you don't have a DL you exceed the speed limit and get caught....yes you get charged for speeding, but the worst offence is driving without the DL ?...correct ?

related to the Thai WP's

working at place none designated but you do have a WP, fine possible suspension

working without a WP...Fine, possible jail possible deportation

not the same...

If you would like to compare things then i would rather compare it (in a western country) with driving on a motorbike when you only have a DL for a car. You don't have a license at all for a bike.

Technically if you even do work off the premises of the designated address in your permit, you are breaking the law.

Essentially, everyone answering a work email at home is breaking the law. I.e. if they don't like u you can be shopped in a second.

Not strictly true depends on what the description in the WP is, the designated address in mine is in BKK, but there are words to the effect I can work country wide at multiple locations

My WP has multiple locations on it, so I am OK. I think the point about doing work outside of the employment contract may be more of an issue though
