Anyone know if i can work in thailand with non-o based on marriage to a thai?

If i can, are there certain job i can't or can?

Really? I had no idea you could obtain a work permit on an O. Always thought you had to get a Non B and my accountant always said the same thing. I have the same visa, Non O based on Marriage and have a 2 year old son from that marriage (born in Thailand). Anyone know what the procedure is then to get the WP on the Non O visa?

I will certainly check this out. One thing which might make a difference is that I do not have the 400K deposited in a bank account here. Not sure this is a requirement or not. In any case, if anyone here has a suggestion of which Lawyer/ Accountant I could speak to for some "real" advise as to what to do I would appreciate it. I am based in Phuket, so of course it would be handy to have one here. Thanks guys.

You don't have to have 400k baht in your bank to get a work permit if you have a non-o visa. That is a one of the 2 financial requirements to get an extension of stay based upon marriage. The other is 40k baht income which can be from working.

Yes, you get get a Work Permit on an O visa.

There's a list of jobs prohibited to foreigners her http://www.thaivisa.com/330-0.html, what is your profession?

Is that list accurate as i noticed auction and seems many falangs are auctioneer's. Also legal service with all those guys helping with visas?

They may work as auctioneers, but there is probably a slightly different job title on their WP.

I have twice obtained a Work Permit on an O visa. The first time was a bit of pain. The guy in the labour office said I couldn't get it, because all he knew was O visa for retirement. I had to go to immigration, who were not sure, so they phoned a friend in Bangkok to get conformation. I returned to the labour office, then managed to get the guy to call immigration. He was a little put out as he lost face.

The seconded year no problem.

It is actually up to the Labor Office issuing the work permit. There have been some reports that some will not issue a WP on a non-O for marriage but they are few and far between. It's best to check with the Labor Office that you are using to see exactly what their requirements are! Things change daily here especially when there is a "new boss" that wants to assert his authority.

Yes, check with your Labor Office. You can also get a one year (only) WP with a retirement visa, but after one year you must convert the visa to a Non-B.

Aha!

I have only just started looking into this so am somewhat green to say the least.

I am also married to a Thai (who has dual nationality) and our first child was born in Thailand.

After my first look through for obtaining a work permit/visa it all seemed rather contradictory.

We are looking at moving back to Thailand, possibly this year so I would love to know the correct way to enable me to work in a business owned by myself and the wife.

There are many work permit offices that will not even accept a work permit application if you have non-o visa or extension of stay based upon retirement. They certainly will not issue them.

I have a work permit on a marriage visa and this has been the case since I took up my first job in Thailand 10 years ago. I have not experienced any problems in renewals and I am now almost 70.

That list cannot be correct. I know people working in several of those jobs legally - especially falang lawyers, which this list prohibits.

It all depends on the job description.

Do they really go to court and address the judge? I doubt it.

The law says you need a non immigrant visa - a non immigrant visa issued on grounds of marriage meets the legal requirements - there's no discretion given to the labour office in this.

If the labour office gives you problems when you have a non immigrant visa, then take a Thai lawyer with you so he can point them to the appropriate places in the law.

Can share my experience - I travel a lot as a international development consultant but live in Thailand and am normally here on a multiple entry non-Immigrant O Visa. I have never managed to get my non-immigrant O visa moved into an extended stay based on my parentage of 2 Thai children which I have with my long-term partner (we are not married) because of shifting interpretations / requirements at my Immigration office - discussed in a separate stream.

I was once asked to do some work for a local logistics company here in Bangkok and was told they could easily organise a work permit - this they did in a day using a copy of my passport (relevant pages) and my signature on the application form but I did notice that the WP issued expired a couple of days before my O visa expired - but it was only a short-term job which didn't even go on for as long the issued WP. So it seems to be no problem and seems to be most easily done by the Thai employer or Company offering you a job.

I meet someone here in Bangkok who got offered a job and was refused a work permit when he applied personally and he was told that they do not issue WPs to those here on a retirement Visa. Equally I also know someone on a retirement Visa who got his WP with no problem and gets it renewed every time he does his annual extension of permission to stay exercise.

Their work permits will say 'consultant' or something broad.

Yes, this is what I have a Non Immigrant O based on marriage with a work permit. I actually want extend for a year, but at the moment do not have 400,000 in my Thai bank account, and just found out about this 40,000 Baht option, which is going to be the route I go.

also, working as a falang lawyer in Thailand is not "work permit applicable" and is illegal???l...oooh so the American guy I met at the Embassy who was bragging about having a cushy lawyer job was probably working illegally? What about consulting?
