June 28, 201412 yr Yesterday I picked up my Non O-A visa from the Thai Embassy in Sweden valid for a year, with 90 days reporting , at the same time I also received the Visa for my son who is 12 years. The embassy issued a non O visa but valid for only 90 days which I think is strange due to the fact that I'm his legal guardian and a dependent child and we are going to live in Thailand , my question is can I extend his visa in Thailand ? Thankful for advise.
June 28, 201412 yr Is it a single or multiple entry visa. Normally they do multiple entry visas. Dependent extensions can only be done for extensions obtained at immigration. Your one year entry from the OA visa does not qualify for him to get an extension of stay. The only option for him to get an extension is one based upon attending school. He could get that for his non-o visa entry.
June 28, 201412 yr Author His visa is a single entry Visa, and yes he will attend school , when is the time to convert his Visa and what kind of paperwork is required , we will enter Thailand Aug 15, and thanks for such a quick reply , greatly appreciated
June 28, 201412 yr You got your visas a bit early. You are loosing a lot of time on your visa validity because of doing that. He can apply for the extension during the last 30 days of his 90 day entry. Paperwork from the school will be needed to get it. If you enroll him a school that has foreign students they will know what is needed.
June 28, 201412 yr Author Is't the 90 days starts to count the from the day you enter the country (The Visa says enter before Sep 2014) which I guess means that the right time to convert his Visa would be around Oct 15 due to our arrival Aug 15. /Thanks for your help
June 28, 201412 yr The Visa is valid from the day it is issued. Do you have a Multi or Single entry Non Imm O-A Visa?
June 29, 201412 yr Author For my son it's a single entry visa, which I want to extend inside Thailand due to my child is a minor depending on me and my wife which is Thai. I was told that I could not get a marriage visa and claim him as dependent hence my child is not my wife's biological child, he is Swedish. I would prefer a marriage visa before a Non immigrant O-A visa which I have. I don't understand this rules . If a Thai woman bring here Thai children with her and marry a EU Citizen, she and the children will automatically get the same resident permit . but I understand that different countries has different rules, but for me i don't make any common sense.
June 29, 201412 yr You could of gotten an extension of stay based upon marriage. But is a bit late to do it since you now have the OA visa. Your son I believe can get an extension of stay for being your wife's step child. Your marriage certificate and his birth certificate should be all that is needed. This from police order.777/2551 2.18 In the case of being a family member of a Thai national (applicable only to parents, spouse, children, adopted children, or spouse’s children): Each permission shall be granted for no more than one year. (4) In the case of children, adopted children, or spouse’s children, said children, adopted children, or spouse’s children must not be married, must live with the alien as part of the family, and must not be over 20 years of age; or ( You should go to your local immigration office after you get here to find out what their requirements are.
June 29, 201412 yr Author If i understand this quote right I should also convert my OA visa to a marriage visa , the financial requirement are less and I could in the future apply for a working permit if I want. Thanks for your "star" support
June 29, 201412 yr You do not convert. When it is time to do your extension you simply ask for an extension based on marriage instead on based on retirement.
June 29, 201412 yr If i understand this quote right I should also convert my OA visa to a marriage visa , the financial requirement are less and I could in the future apply for a working permit if I want. Thanks for your "star" support The quoted info is for you son's extension. It would be for having a family member who is Thai instead of one for going to school. You will not be able to get an extension of stay based upon marriage until the first one year entry from your OA visa ends or the one you will get if you leave the country and re-enter before your visa expires. The only way to get it earlier than when those entries end would be to leave leave the country after your visa expires and re-enter the country with a tingle entry non-o visa and then extend that entry.
