Sexual assault suspect beaten to death in Thai prison

Why do some immediately turn such an event into a venue for vicious comment about what should happen to persons who commit abhorrent crimes?  While I believe that I am as angered and disgusted as any of the readers by such creatures who  would violate a child in any way, let alone rape their own child,  I first need to be satisfied as to their guilt!!  Then, I may allow that dark place in my brain begin to explore and devise a fit punishment. The story includes the comment that Mr. Nunkaew denied having committed the offence and claimed innocence.  Surely that denial immediately creates the need for a trial in the mind of any fair-minded person!!  An accusation is just that and the man deserved the chance to defend himself.  I don't see any mention of supporting evidence, although the police may well be in possession of such.  I sure would hope so, for to think that he was arrested and charged with no evidence save the word of his wife is scary...especially in view of his subsequent murder.  The officials are claiming that his death by beating was unrelated to the charge.....Oh, really!!??  And cows jump over the moon, is my instinctive reaction.  That claim smacks of a serious case of CYA on their part.  I believe that in many, if not most, parts of the world, the man would have been placed into a protective custody unit that houses such alleged offenders.  This incident, in my humble opinion, is a sad comment on the Thai remand system and I hope that an inquest into his death is a prerequisite result.  Also, again in my humble opinion, if justice is truly to be shown, not only an investigation into his death needs to occur, but also an inquiry as to what evidence the police had to lay the charge.  The man deserves no less!!

All the people here baying for public hangings, extra-judicial beatings, and good old fashioned capital punishment ought to read Steven Pinker's Angels of our Better Nature. He points out, for instance, that the homicide rate in western Europe in the Middle Ages was between 50-100 per 100,000 whereas today, it is around 1 per 100,000 (and he shows that it's not simply about modern medicine saving more victims). Now those Middle Ages were also the age of public (and sadistic) executions: evisceration, breaking on the wheel, drawing and quartering, etc. But all that public punishment didn't seem to make a dent in rates of violent crime. He identifies a number of things that did, however, make a difference, and one of those is consistent and fair administration of justice by the state... it's not so much the severity of the punishments but the fair application of them that makes the difference. The scions of rich families shouldn't be let off the hook for their crimes, and someone smoking weed at home should not receive a longer sentence than a drunk driver.

 

So I think this is what Thailand needs to focus on. Not coming up with more severe punishments, but creating a justice system that is actually just and is seen as so by the population. When people feel they can rely on the justice system to get it right, they are less likely to take matters into their own hands. And when the mob takes matters into it's own hands, they often get it wrong. That's why civilisations have justice systems in the first place.

 

Yeah, easy to say, but not easy to do....

Raping children is without doubt one of the most emotive crimes, it ignites a swath of hatred in across society with almost everyone joining in and contributing to the hate campaign. I feel the same as everyone else about people who rape children, and it is always rape.

 

The only point i would make, which I predict may not be popular is that people are genuinely glad that he was beaten to death in prison on his first night. Now, again I fully accept that if the man was guilty they should lock him up and leave his sick carcass to rot away in prison for the rest of his days (I do not believe in the death penalty). But this man was innocent at that time, he had only been accused, he had not been to trial and no one had yet convicted him after reviewing the evidence.

 

So, what we really have here is a man suspected of a crime being beaten to death on his first night been held in remand, that is absolutely terrible. The only reason we are not responding to this differently is because what he was accused of, as I mention that emotional response to what can only be described as one of the worst crimes. So, we are ok to wave his rights as a human being and celebrate his murder.

 

But let's assume for a minute that he was innocent, because at the moment he technically was. Should we now not be asking about how he was beaten to death and why don't the police really seem to know anything? After all it can not be too difficult to arrest suspects, they were all locked in a cage together. Should we not all be saying how can the police let this happen to this man and why wasn't he kept safe?

 

The responses to this article and the "good, he got what he deserved" attitude is because of the crime he was accused of but it is very risky to respond to this in this way. What other crimes does someone have to be accused of for us to ignore the rights of the accused, rape, murder, drug trafficking, kiddy porn or maybe all of the above depending on your opinion.

 

The police right now should be under huge pressure to find out who was responsible and bringing them to trial and the man should be buried as an innocent man.

So if you yourself were just accused of a crime, you think that you should be beaten to death in prison on your first day before you got to stand trial or confess?

so in just 2 days this is how your wife using your daughter in law ,can dispose of you. Could be a game changer for some.Even if you scream your innocence nobody wants to listen,That is one serious nightmare. 

 

This is what I have been trying to point out.

 

Everybody go back to the photo of the alleged perp in the first post in this thread. Take a good look at the expression on his face.

 

Now go and do something really nice for your wife.

Here's how I would write the law. Anyone that infringes on your freedom such as robbing, raping, assaulting, or otherwise willfully inflicts physical harm, should not be covered by the law themselves during the violation. That means, if someone walk up to you and tries to snatch your bag, at which point your gun comes out and their head blows off, you were in the right to do so because you were assaulted. It's a human right to defend ourselves to stay alive. The moment our safety is threatened by another human we should have the right to instinctively defend ourselves.

Everybody deserves a fair trail not to be beaten to death in jail waiting to face the court.

And every young child deserves to be treated with love and care.
He did deserve a fair trial but the girl deserved the right of NOT being abused
At the end of the day they both lost


So it's a fact he committed the act? Seems so from your statement about "the girl".

Surely a woman would never lie about a man and her daughter right?

Seems many here are ready to believe what they read on a news article as fact and even allegations in said article as proof of guilt.

People lie, and lie often to intentionally hurt others, especially in bad relationships.

Best you hope you're never wrongly accused, for you're damned from the beginning, according to your own words.

Not for rape because will always be an element of he said she said etc but for child rape or molestation then there can be no consent issues so take them out the back of the court put a bullet in their head rid the planet of some vermin

The guy was locked up on his wife's evidence and was murdered in gaol. Murderous rednecks of Thaivisa......get a grip on yourselves!

I don't know if this is a good news or bad news. I really encourage farang opinion on this one. Honest opinion please.

 

I have 3 children and all those news makes me quite think that the thai prison rules,beaten by death,should be a common matter for those animals.But after,thinking deeply and long,what about if,ma like him,was really innocent?Anyone deserve a trial.We are in 2014,not in the ancient Sparta.I visted somehow 3 thai prisons and whe u come inside,no matter of what u are innocent or not,if they want kill u......you done

No fair process or innocent until proven guilty in your weird World then. How ironic would it be if your wife or strumpet accused you of the same thing out of spite, it would be interesting to see if you flapped your gums asking to be killed without a trial.

I always struggle with stories like this.  I'm a father of 4 daughters and 2 step-daughters, ranging from 10 years old to 20 years.  These types of events are always a father's worse nightmare.  However, a lot of people are already celebrating over this event - which is miles away from the recent SRT event.  First, the story switches back and forth from using Sexual Assault and Rape.  Rape is sexual assault, but sexual assault is not rape - so which one happened???  A 41 year old man rapping a 7 year - a simple medical exam would prove this, as she would have been severely damaged in the vaginal region.  The laws around sexual assault can include items such as touching a private area - which could mean a whole lot of things.  Nearly every guy who has visited a go go bar or bars with ladies could be charge with sexual assault for a simple slap on the butt or placing a tip in her bra.

 

If he did rape this poor little girl, then once it was proven, sentenced - what happens in jail stays in jail!!!  However, if this was something (not that I support this) like pulling her pants down to give her a good slap on the backside as a punishment for doing something bad on the farm - well highly wrong and bad choice of punishment - but a far cry from Rape - and having your life taken because of this is clearly wrong.

He was a suspect did not confess so he did deserve a trial. I hope he was guilty then he got his deserve if not the others need to be charged with murder.

I have a couple of questions;

They arrested him 3 days after the alleged event of rape on his 7 year old step daughter. His wife informed the Police. Why 3 days later?  And if your 7 year old girl was raped, as a mother would you not seek medical attention for your child?       We have not heard of any reports of this.

if guilty no punishment is too harsh... IF guilty  your lynch mob mentality sucks  LOTS OF MEN ARE WRONGLY ACCUSED BY jilted wives and subsequently found to be innocent...mind your ps and qs and hope you never find yourself in his position

All kiddie fiddlers (where there is absolute certainty that they did it) should be removed from the planet, definitely where rape is concerned.  If he did it, he got what he deserved.  If he didn't, let's hope karma takes care of his wife...but only once the daughter is old enough to look after herself.

He obviously stood trial by his peers in prison and was found guilty they obviously didn’t think he was innocent, anyone having sexual relations with children should all get the same trial and punishment in prison sounds like a good deterrent to me beaten to death he won’t be committing the same offence again I hope some of the prison culprits will now get a pardon after doing their honoured duty for their country.
