Is there a special visa either I or my sons could get? We are all UK citizens, they have a thai father named on the birth certificate, no thai citizenship as yet. Me and the father are not married.

The are Thai citizens from birth. Are they Thai birth certificates or do you only have the UK ones.

You can non-o visas for them from the embassy or one of the consulates as returning Thai citizens. And one year extension of stay at immigration for any type of entry.

You can get a non-o visa as the parent of a Thai child.

With the help of the father you should get Thai birth certificates for the children. With that their Thai nationality is established and you can get a non-O visa based on that and yearly extensions of stay if you can show an income of 40,000 a year OR 400,000 baht in abank account in Thailand.

The children could get their Thai passport and would of course not need any visa.

With as it is now, you could probably get a non-O visa but no extensions of stay are possible for you until the children get their Thai birth certificate. That must be arranged by the Thai embassy in London, or if you are already in Thailand through the Thai department of consular affairs.

The reason I had never got them thai birth certificate/ passports was because of the possibility of military service when they are 18. Does this still apply?

They would not be called for the draft until the age of 21.

My normal advice is why worry about something that will not be a problem for many years if the children are young. There might not be a draft by the time they are 21.

Also at the moment there are many ways to get around it.

It is certainly not worth all the complications that can arise from not getting their birth certificates and passports.
