Ex-PM Yingluck's impeachment hearing tentatively postponed

BANGKOK, Nov 11 - Thailand's National Legislative Assembly (NLA) whip has tentatively postponed the legislative body's impeachment debate against ex-premier Yingluck Shinawatra from tomorrow to November 28, pending formal approval by the Assembly tomorrow.

The decision was reached during a meeting this afternoon, according to whip spokesperson Dr Jetn Sirathranont.

The whip considered a request by Ms Yingluck’s lawyer to put off its deliberation for 30 days.

Dr Jetn said the Assembly whip considered the request and agreed that the ousted premier needs at least 15 days to study official charges from the NLA secretariat as stipulated by Assembly regulations.

According to her lawyer, Ms Yingluck received the documents only on Friday.

The NLA had earlier included the National Anti-Corruption Commission’s petition to impeach the ex-premier in its agenda for consideration at its meeting tomorrow.

Ms Yingluck is accused by the anti-graft committee of dereliction of duty for failing to terminate the rice-pledging scheme despite allegedly massive corruption and losses to the government.

Dr Jetn said Ms Yingluck could submit further evidence and requests for additional witnesses with the NLA for her defense.

The spokesperson said the whip's decision will presented to the Assembly tomorrow for approval and he is confident that the legislators will agree to the request.

He also said Ms Yingluck’s legal team will be allowed to clarify its request for postponement of the case to the Assembly tomorrow. (MCOT online news)

Just allowing more time to get packed. So much shopping and has to organize how much she is allowed to take out the country. She couldn't receive it if she has only just returned, which address did she give for the documents, one she rarely uses so therefore they would be late due to being diverted.

The Lady is absolutely right.

Stop bothering her with impeachment orders and other nonsense.

She has to go shopping for that latest Prada bag, recently arrived in CM, and also has to practice a lot her crying techniques to convince the cheated farmers and the taxpayers that all that money lost, wasn't hers or her brothers fault.

To all the posters here suffering from selective-memory-syndrome, may I suggest you take a look at the Thai Khem Khaeng scheme run by the previous Democrat-led government which incurred losses as heavy as those of the ricepledging scheme!!

So Abhisit should be before Yingluck in the impeachment line-up!!

So it should be postponed, never heard a case that the defence cannot proceed because the prosecution has forgot to forward the particulars for the defence to pre-pair a case, what else is being done at the NLA. and NACC that is not up to standard. coffee1.gif

Er, didn't much the same happen to Thaksin? He was allowed to walk, and then to wallow in the criminality. Whoever Is In Charge At The Moment said recently we must stop talking about the brother. Soon he will order us to stop talking about the ....... Ying*uck. Presumably after she has secreted all her ill-gotten billions somewhere safe from somchais ( = anywhere at all).

A big part of the spending here was outside the budget!!

A for the 1 trillion loss in the ricepledging! Absolute nonsense. What the critics conveniently "forget" is the fact that rice was actually sold during the 3 years.

I am in no way way defending the ricepledging, a 10 year old could see the stupidity of the scheme, but the boys in yellow were not much better/smarter themselves!!

How do you compare the rice pledging scheme, that was planned to at least break even, with a scheme that was designed as a spending program to boost the economy during the GFC? The money that was spent by the Democrats was spent on infrastructure projects. It's not as if any government plans to break even when spending money on infrastructure (except for money saved over the long term). (and yes, no doubt there was corruption)

BANGKOK: -- THE NATIONAL Legislative Assembly whip resolved yesterday to defer impeachment proceedings against ex-PM Yingluck Shinawatra till November 28 over the rice-pledging scheme because she had not yet looked into the documents or prepared herself to fight the case.

NLA whip spokesman Jetn Sirathranont said the NLA whip was informed the impeachment documents had been delivered to Yingluck on November 7 - and the NLA scheduled the impeachment hearing for November 12.

But according to NLA regulations, Yingluck should be notified at least 15 days in advance.

So, the whip resolved to postpone the first meeting of the impeachment, which was earlier scheduled for today, till November 22. But that is a holiday, so the meeting was set for Nov 28.

The decision was reached after Pheu Thai Party lawyers asked the NLA to defer the case for 30 days, saying that Yingluck had not had enough time to prepare herself since she had just returned from an overseas trip.

Jetn dismissed Pheu Thai legal official Ruangkrai Leekijwattana's move requesting the NLA withdraw the impeachment of Yingluck, because the 2014 interim charter does not include impeachment of politicians and the NLA might illegally stretch its power beyond what is stipulated in the charter.

Jetn insisted the NLA would continue the impeachment move without fear, even though Ruangkrai has threatened to file a petition with the National Anti-Corruption Commission (NACC) accusing the assembly of malfeasance.

Yingluck faces a five-year political ban if she is impeached.

The NACC submitted its impeachment writ to the NLA yesterday on Yingluck over the rice-pledging scheme.

The writ said on August 23, 2011 Yingluck delivered a policy address to Parliament that her government would prevent and suppress corruption and would implement the rice-pledging scheme by having ordinary rice pledged at Bt15,000 per tonne and jasmine rice at Bt20,000 per tonne.

The NACC twice issued an urgent letter of recommendation to Yingluck to stop corruption in the rice-pledging scheme, once on October 7, 2011 and the second time on April 30, 2012.

The Finance Ministry's Post-Audit Committee on the rice-pledging scheme also submitted its reports to Yingluck, which showed the subsidy scheme reported a loss of around Bt32 billion by May 31, 2012.

Yingluck received the second report from the committee, which showed the scheme had accumulated losses at Bt220 billion by January 31, 2013 and the third report, which revealed the project had accumulated losses at Bt332 billion by May 31, 2013.

The NACC writ said Yingluck continued the loss-making operation even though she received three reports of heavy losses from the post-audit committee.

The Office of the Auditor-General also submitted its recommendation to Yingluck, which revealed that the rice-pledging scheme presented loopholes and weaknesses at every step of procedures that made it vulnerable to corruption. Yingluck was adamant about continuing the project even though it had caused great financial damage to the state, the writ said.

"Even though there was no evidence the defendant was complicit in the corruption, she failed to live up to her policy address to Parliament for her failure to stop corruption and heaviest losses incurred to the country from the rice pledging scheme.''

The NACC had resolved unanimously with seven votes to impeach Yingluck for intentionally breaching Article 178 of the 2007 charter, Article 11 of the State Administration Act, Article 58 of the Constitution Organic Law on Prevention and Suppression of Corruption Act.

So if they continue down this track and there is any corruption involving any corruption I fully expect consistency from this mob and impeach the present PM.

This is a farce !

There is no evidence to show she was complicit which is why she isn't being charged with corruption.

As head of the rice committee, she is being charged with allowing the scheme to continue even though she was shown evidence of corruption.

I don't know why the yellow supporters keep going down the track she is going to flee

She's been out of the country twice and came back.

It's up to the prosecutors to prove guilt and it's seems to me they gave a half assed case and can't get there act together yet they still want to grab a few headlines and a few licks in against ying.

I think she should be quietly confident she will have no case to answer but then again they are out to get her no matter what means they use.

Do I have to post the links again to prove that she and her defense lawyers have known that there will be impeachment proceedings on the grounds of negligence since as far back as February ?

No time to prepare defense but time for overseas trips and touchie feelie, moral boosting, electioneering trips to issan.

And you choose to believe her lawyers one of whom has already done time for the cake box scandal and another who is on a jail term.

The NLA believed Yinglucks lawyers and delayed the case so what's that say, also these documents , if sent out , would have been delivered by special courier and signed for.

What about your yellow friends at the Airport a few years ago. How long have they been dragging there feet on that one. Let them impeach her when the yellows from the airport blockage are behind bars.

The atimes article dated June 27, 2009 includes an interesting interview with former Democrat Finance Minister Korn Chatikavanij.
