NLA accepts lawyers' plea to defer Yingluck's impeachment proceedings

BANGKOK: -- The National Legislative Assembly (NLA) yesterday voted to postpone impeachment proceedings against former prime minister Yingluck Shinawatra after her lawyers insisted that she needed enough time to prepare her defence as indicated in the NLA meeting protocol.

Yingluck's three lawyers were present at the NLA meeting to explain why they wanted the first round of impeachment proceedings to be deferred by 30 days.

NLA president Pornpetch Wichitcholchai said the National Anti-Corruption Commission (NACC) had delivered the copy of the writ to the NLA on October 14, and that copies of the writ had been distributed among NLA members on October 28.

He added that officials had been instructed to contact Yingluck's lawyers to tell them that the write had been delivered to her, but her legal team said she had not returned from an overseas trip. He then went on to say that he had copies of the writ delivered to Yingluck's home twice - on October 29 and November 7 - and both times somebody had signed to receive the documents.

However, the former PM's lawyer Anek Kamchum said that in accordance with NLA's meeting protocols, the NACC writ should be delivered to the accused at least 15 days before the first meeting on the impeachment proceedings are held. The first such meeting was scheduled to be held yesterday.

He also pointed out that Yingluck had returned to Thailand on November 2, so she did not have enough time to prepare her defence. He said that if the documents were delivered to Yingluck on November 7, as claimed by the NLA president, then she would only have five days to study the 3,870 pages of the writ.

He also called on the NLA president to allow Yingluck's legal team to make copies of the 3,870 pages, even though they were classified documents.

Four NLA members, including Saowanee Suwannacheep and Monthian Buntan, took to the floor asking the lawyers why they did not contact Yingluck while she was overseas to alert her about this development, especially since the news had been widely covered by the media.

Norwit Lalaeng, another member of Yingluck's team of lawyers, said that according to the NLA meeting protocols, the defendant has to receive the documents officially, not be informed over the phone.

The NLA voted 167:16, with seven abstentions, to defer the first meeting of the impeachment proceedings to November 28 as proposed by the NLA whip secretary Somchai Swangkarnwith.

Pornpetch said Yingluck's lawyers would be allowed to copy all the 3,870 pages of the writ, provided the copying was done only during official hours.

The NACC has accused Yingluck of failing to stem corruption and massive losses in the rice-pledging scheme as well as intentionally breaching Article 178 of the 2007 Constitution, Article 11 of the State Administration Act, Article 58 of the Constitution Organic Law on Prevention and Suppression of Corruption Act.

I see the lawyers conveniently forgot about the Oct 29 date.

Is it the fault of the NLA that Yingluck decided she must go on an overseas trip at that time and did she not stay longer than planned, must they adjust their schedule for a defendant ?

I see she got less than the 30 asked for, more days to think up another excuse to not attend.

This is a blow for the yellows on here yet another set back because Yingluck and her team are just to smart for this lot.

Bumping her up the list and rushing to get something anything other is just showing the bias towards yingluck and the PTP.

The fact is she is just to popular and the peoples choice and this mob have no idea what to do about it because the backlash at the polls is already going to sweep the PTP back into power and if she's the leader the yellows will be decimated.

Hence the targeting while those before are on the very very back burner .

The lawyers may be getting a little wriggle room on deferring the inevitable, but it won't make a jot of difference to the outcome.

She is toast. She won't even read the massive writ, she wouldn't even understand it. She is an airhead.

The lawyers already had all this, it is those who will be doing the scrutinizing and providing the defence, she is merely the puppet.

If and when she is impeached I hope the NACC then push for criminal prosecution of gross criminal negligence. She after all AWARDED herself the job of chairperson of the scam scheme, and pretty much claimed the salary and refused to do the job at ANY level.

She stole that salary and allowed Thailand to lose over 700 Bn baht in the process.

20 years prison might straighten her out, all her acolytes with her.

You obviously have little understanding of how the Thai justice system works for people of her status.......

But obviously the lawyers can inform her of the documents over the phone. I don't even know why they're dodging and avoiding the inevitable, she will be impeached and receive a ban, but like the rest of the family she will never do time. This country will never change until someone with money and influence goes to jail.

eg. her sister-in-law requested the court delay a hearing against her because she was seeking medical treatment in Singapore for a headache.

we are talking about foot dragging here. why change the subject. plus the cost keeping going up and up every time you post. time you take a few days off of TV and relax and gain your senses back. but of course this is a typical yellow tactic to change the subject when it don't suit them.

It's very entertaining to see how something so blase can be spun completely away from reallity by TV readers. It's one reason I read TV as much as I do the comics.

Yingluck's attorneries request the NLA follow its own protocols. The NLA votes and agrees to follow its protocols. Yingluck gets 15 more days to review the charges as per protocol. In itself hardly blockbuster news. No conspiracy, no collusion, no conflict of interest - boring news.
