Just got kicked out of thai with valid visa

Hi guys,

I just got kicked out of thailand with an ED visa totally valid from waleen and a re entry. I arrived from 3 days holiday in Hong Kong and the immigration officer told me my visa was cancelled. I can speak thai but can not read or write. He told me 6 month is enough to read and write and asked me to buy a ticket back to my country.

He told me i could never re entrer the country with this passport. They were stopping every ED visa for testing thai skills.

I wonder if there's a new crackdown being launched ?

Did they let you in on a 30 day visa exemption, a 7 day 'refusal entrance' or refuse entrance completely at the airport and make you leave on the next flight available ?

Edit : From what I've heard if you're refused entrance you can buy a ticket to fly anywhere you want, you don't have to go back to whichever country you come from.

Interesting! Since the ED visa is not only issued to learn Thai, What happens to the Brit that is enrolled in a Japanese course or the Japanese person that is enrolled in an English course?

They didnt let me in. I asked 100 times to fly anywhere else than my country and it was refused. They said the only country i can go back is France. Immigration officer told me every ed visa will be checked.

This is just plain wrong, did you ask for the person in charge ?

Whether or not I agree with it, right or wrong, I can understand that they can refuse you entry into Thailand. However, since you are not "officially" in Thailand you should be able to choose your alternate destination, not return to your home country.

IMHO I suspect that the only reason that they have not cracked down on multiple back to back tourist visas is the negative impact that it would have on the tourism industry. They are forcing those that are long term residents, possibly working illegally, to go the tourist visa route to stay here! I often wonder why people would go the ED visa route and enroll in an expensive school only stay here when double entry TVs are available in neighboring countries without paying enrollment fees and triples in most home countries.

Two double entry tourist visas, 4000 baht, 4 extensions 7600 baht for a total of 11,600 for 360 days versus the cost of enrollment in a school, plus ED visa and cost of extensions.

Due to the original Visa crack down they may be seeing an increase in ED visa's coming through and decided to challenge those carrying them. Totally self destructive as what ever figures TAT publish you would have to be blind not to realise the tourist industry is in melt down

I was under the understanding that once you were denied entry, they would require you to fly back to the country of your passport -- using approved airlines. They would not allow you to fly to another ASEAN country since they had agreements in place to not toss their problem back on other countries.

This superior is not playing by the rules, from reading lots of posts on this subject over the years I'm certain you can fly anywhere you want to - it's nothing to do with them where you fly to - don't accept the judgement of one guy who might be having a bad day.

Unless there has been a change in the rules which nobody knows about.

If you wait a while until he finishes his shift perhaps another superior officer will come along who is more accomodating.

I would hold off on booking a flight all the way to France until you've had the chance to seek more detailed advice on this matter and speak to a differrent superior officer.

Maybe call a lawyer in Thailand as soon as their offices open and confirm if they're messing you around or not.

Yes, I remember, they said they wouldn't let him in due to his notoriety - very different scenario.

Try and wait around for the next shift of Immigration to start work, you may have a better chance then.

There is no law requiring you to fly back to your country - so at least you can contest that part, but you have to be adamant about talking to the supervisor. As in your case there is no extradition happening - just a refusal to enter the country. Don't be rude or condescending with the officials, just state that there indeed are laws that do not require you to travel to the country.

Have you been following the threads in this forum for the last 4 months ? There has been a massive crackdown on back-to-back tourist visas and 30-day visa exemptions, but on my last flight in (18 Nov), I was pleasantly surprised to see that the lines were moving quickly and passports were being stamped and handed back very quickly. My extension of stay / re-entry permit meant I didnt need to play 20 questions, but I do feel for the OP if he has made a genuine effort to learn spoken Thai but cant read or write.

The crackdown on the Ed visa was forecast by many here when it became apparent that many who were being bounced would try that option, and there are numerous reports here of people being given a very hard time when entering with an Ed visa. The better option for some may be the Elite card, but many of the same people who claimed they were 'cashed up' objected vehemently to the idea that they needed to pay just to stay in Thailand - go figure.

If this is indicative of an ongoing willingness to deny entry to people staying here long term for something other than tourism or education, I can see an upside. Bye-bye digital nomads under 50. Either stump up the cash or run your multinational corporation from a Starbucks in Pnomh Penh.

Well, what problem are they tossing back? Ok, so I can't speak to other ASEAN countries and their agreements then, but he could certainly fly to Japan, or Hong Kong, or anywhere in the EU, or most South American countries, or for that matter, the USA. Thai immigration has no right to deny him that. It is tantamount to false imprisonment.

They don't want him in Thailand, and there are no outstanding warrants anywhere, he can go wherever he is eligible to go.

This is very different to having being convicted of a crime (doing something wrong) and subsequently deported.

I seem to remember the case of a certain Russian lady being denied entry in Phuket a few months ago, after being denied entry she flew out of Thailand to Malaysia. They didn't force her to go back to Russia.

So either something has changed or they are lying.

Right from the start, this crackdown has been punctuated by the individual interpretation of the rules made by each IO on the day. Has something 'changed' since the Russian woman was sent back to M'sia ? Possibly, but it's more likely that they do have a ruling somewhere that specifies return to the passport holders country of origin - the southern division of Immigration arent held in terrifically high esteem on this forum and its entirely possible that they dont even know their own rules. I guess that can happen when your first priority when opening a passport is to extract the 500-baht note from it .....

i have no idea how she would have reacted if my itinerary included a flight to PP or KL after BKK, but it was only when I was able to reassure her that I live in Thailand that she let it go. If they day comes that you must have a return flight to your home country in your travel itinerary, I'm guessing there will be some very unhappy campers out there.

When they nearly denied me, last April, I was able to fly anywhere that I would have decided.

There is even a Thai airways office adjacent the immigration interrogation room who was waiting for my money to buy a ticket...

Hopefully, they realized their mistake and cancelled the denied stamp.

At that time, the head of Survarnabumi was a lady and she suggested me to make a new passport, because I might had to face a lot of questions when re-entering Thailand.

We don't know the full story. Usually Immigration will allow you to fly anywhere you like but he must have a black mark against him or Immigration have upped the ante. Maybe he was seen as a serial overstayer or border runner or had too many ED Visas. The truth will be revealed.
