BANGKOK: -- Anek Laothamatas, chairman of the Constitution Drafting Committee (CDC)'s subcommittee on promoting reconciliation, yesterday insisted on proposing an amnesty idea for the charter drafters to consider but said it needed to be scrutinised carefully.

"I insisted on forwarding the report to the CDC, because the most important matter on the topic of reconciliation is making conflicting groups, or people who were affected by the political crises, feel love and unity towards one another," he said.

Anek said it was unclear if the CDC would support his amnesty proposal. He said there were two means to issue an amnesty bill - the Cabinet could issue it through executive decree or PM General Prayut Chan-o-cha, as chief of the National Council for Peace and Order, could issue it by exercising his overriding power via Article 44 of the interim charter.

Anek said his subcommittee's proposals to the CDC centred on creating a negotiation and recovery mechanism on disputes by including people who were not government officials to participate in the process.

So, Amnesty is like a 'Get out of Jail card' for people that have, so far, avoided going to jail in the first place! What a crock!

The current incumbents may well think it is a good idea as what they did to gain power was not exactly kosher now was it?

This is the very essence of what polarizes this country and is a most negative action to providing a sense of unity.

If you do the crime then you should do the time, is a mandate that should apply to all regardless of their wealth, position and much referenced influence. For decades double standards have been applied by the government and judiciary and until this practice is brought to an end this country will remain fractured and dysfunctional.

It has absolutely nothing to do with forgiveness which is a much touted red herring. References to amnesty in Thailand simply highlight that the acceptance of corruption is still alive and well.

The proposed amnesty by PTP included leaders, particularly Thaksin. It also included an estimated 25,000 corruption cases, including Thaksin's.

An amnesty not including leaders was supported by most people, including the Democrats, prior to the protests.

No, that is not what the CDC described. It proposes political amnesty only, not criminal amnesty. So there is literally no "get out of jail" card. The NRC's position was that political amnesty did not preclude any judicial process, ie., criminal conviction. The NCPO granted itself criminal amnesty as the act of overthrowing the government was against the contitution. Under Article 44 of the Provisional Constitution the Junta can continue to grant itself any inclusive amnesty at any time.

To learn from mistakes you first have to admit you made one. That's not compatible with the rules of Thainess as you will lose face.

I will gladly allow those who want amnesty it, but only if they first admit what they did wrong.

That means listing in public in a Thai publication or on television exactly what they did that was wrong and exactly what they want amnesty for.

Otherwise, how can anyone be sure the person confessing to wrongdoing really deserves amnesty?

So, in order to get "amnesty" and start "reconciliation" let's have a full confession of their crimes from any and all politicians to include:

  • Date, time ,place, and people involved
  • details of all misdemeanors and crimes.
  • and location of same.

Only then is it possible to grant "amnesty" and 'forgive" those who did wrong.

Turnaround as in PTP, or a proxy of it, would be able to regain power.

Pheu-Thai proposed an amnesty bill which everyone was happy with. If it had gone through, the real victims of Thaksins megalomania (the greedy and/or gullible simple folk) would have been freed.

But in an act of supreme treachery, they changed it after the first reading to include Thaksin and all his crimes since 2004. That's when the Democrats walked out - but Pheu-Thai continued regardless and passed it 310:0.

Every single MP who voted for that bill should be in jail and barred for life from politics for abuse of power. Not a single one of these louse had the ethics to oppose it.

I was too young to understand anything but the surface jokes, and I wonder if I'd understand more if I watched it today. That's what torrents are for... But I digress.
