My 2 years old son is born in Thailand from foreigner parents. 1 year ago we were to France together and came back. He has no visa in Thailand. This year I would like to go to France for holiday but I wonder me if at the immigration at the airport (when I will leave Thailand) they will don't ask me for money (overstay)?

The law for the visa always changed. Do you know if today my boy need visa to stay in Thailand? If yes, can I do it from France when I will go with my son.

Some people tell yes he need a visa, other one no until 4 years, so I don't know who believe....

By law he would need a visa, but there is no fine and no penalty for overstay to minors of 15 years.

Your child should have a visa or extension if staying for a long period of time.

When leaving the country they will not be charged a fine for overstay but will get a stamp for it.

If you are on an extension of stay you should get a single entry non-o visa and then get one for them as your dependent.

contact immigration, and get it all in writing.

Visit the nearest immigration office and talk to them, it's better that way than having surprises at the airport.

What country are you from and why or did you register the birth with your Embassy ? You should receive a passport from your home country for the child.

Apparently they may be from France since this will be the 2nd trip to there since the child was born.

Since the child has left the country once already they must have a passport.

Didn't see any mention of the O/P's current age, marital status or reason for being in Thailand for (apparently?) years. If she's here on an extension of stay based on retirement or marriage to a Thai (someone other than the child's parent) or employment, why switch to a new non-imm o visa at this point?

Thank you for your replies. Yes I am French and my son has his passport.

I just checked with my lawyer and she told me that in the law the child should have the same visa than the parents, but in the real at the airport they will just stamp an overstay and that it. She told me that now the child doesn't need visa until 14 years (the law changed).

If someone has his experience to share, she/he is welcome.

There has been no change to the law for them not paying overstay fines if under the age of 15.

That does not make it legal to for them toremain here without a visa or extension of stay.

Not having one can cause problems in the future for registration at some schools.

My kids were born in Thailand and none of us parents are Thai. They got Italian passports. First time out of Thailand I had to bring birth certificates, marriage certificate and fill in some paper at Airport Immigration, in Italy I had to make a visa for them at Thai embassy (work permit and birth certificates are needed) to fly back to Thailand now I am just reporting them every 3 months and have to renew the permanent Visa on yearly basis. I have been told that if they never go out of Thailand, they will not be charged for overstay until 15 y.o.
