I want my daughter, 4 years and born in Thailand, to bring to Holland for a short holiday. She has a Dutch passport, but not a Thai, as the Thai mother does not want to coöperate. Can I expect difficulties at Immigration at the airport leaving Thailand or returning?

In principle she should have no problems to travel to Holland.

But you will need written permission from the mother to take her out of the country.

I believe that a birth certificate is also required as the Dutch passport is presumable issued in Bangkok and used to get her into Thailand.

Hopefully others can provide with more accurate information.

You'd at least need the mother to sign a 'consent to fly' form to cover that angle. Checking in with airline night not be a problem, but immigration might want to see a Thai passport if daughter does not have a Thai visa in her Dutch passport despite being born here. Don't know that presenting a Thai birth certificate would be enough. There is also the issue in getting back into Thailand without a Thai passport as you would have to get her a Thai visa in her Dutch passport, as well as to be able to fly from that end.

My advice: <deleted> the Thai mother money (baht trumps issues here as I'm sure you know) and get her Thai passport sorted... only takes a few days, 1,040 baht.

Normally it is not a problem for a child to leave the country with no entry shown in their foreign passport by showing their birth certificate to prove they were born here.

A child with Thai nationality doing the same thing may have a problem.

You certainly will need consent from your child's mother for them leave the country unless you are the legal father of your child by way of marriage or legitimization. Even if you are the legal father it is advised you have consent.

Since their mother will not help with getting them a passport I suspect you will have the same problem getting the consent.

If the child does not have the same last name you can expect be to asked for permission from the mother to fly out with the child.

I suspect you are and were not married to the mother, meaning that unless you legitimised the child through the court you are not the legal father of the child. Merely being on the birth certificate is not enough. If you are not the legal parent taking the child without permisison from the mother will be kidnapping.

Otherwise, the birth certficate will explain while there is no entry record and allow her to leave on her Dutch passport. When returning, she will need a visa and extensions of stay. On proof of Thai nationality she can get 1 yearly extensions of stay without any problem.

I took a Thai child from Thailand to Netherlands. Consent form was part of visa application forms, not applicable for you, but we were not asked for consent from mother until checkin in Amsterdam for return.
