90 days report and extension of stay not linked?

Are 90 day reports and visits to the immigration to get yearly extension of stay (Non Imm O -Thai wife) not linked - must both be done at all required times?

I have done a 90 day reports in Aug 2014 from previous extension of stay period, then got my extension of visa stay in Nov 2014 applied for early Oct-2014 at immigration for another year. I was thinking my next 90 day report is due 90 days from the November visa extension since I had just spent all day applying for and all day picking up a few weeks later a visa extension which includes my home address? Is this incorrect thinking on my part? Not a word was mention by Chaeng Wattana when I got the visa extension about the 90 day report required 90 days following last 90 day report.

I mailed in a 90 day report for end of January 2015 thinking like this. Now Immigration at Chaeng Wattana phoned wife and said I have to go and pay a fine there for not reporting 90 days from the Aug 90 day report date? (*Edit that would have been due 30-Oct during period I have applied for and was waiting for visa extension).

This is my first experience of doing this, so I guess Immigration is correct as usual - but I would appreciate some guidance here please?

Immigration are correct, only your first extension counts as a 90 day report.

You should have reported in October.

As the fine maxes out at 2000THB, I suppose there is no rush to do this now?

My previous 90 day report paper in passport dated in Aug says I should report again on 30/31-Oct, which is only about 70 days period (not 90 days) and just prior my previous visa extension expiring. I foolishly thought that by going to immigration before this date (early Oct) to get my visa extension I was actually "reporting", but in fact the two reports are therefore not linked.

I wonder if others have been caught by this?

You are not the only one that has thought like you did and had to pay the fine.

There are a few offices that will reset the report date when you do an extension. Mine changes the report date to the date my extension ends if it is after that date when I do the last report before my extension ends.

not same chaeng wattana at all. no reminder. no change in 90 day report cycle.

PITA really i feel i should put chaeng wattana government center as my address as i have to spend so much time there.

Never had that happen ... usually the other way around ...when I do a 90 day report as I get nearer to my annual extension of stay they usually remind me that I will need to do the annual extension before xxx.

Is this documented anywhere on the immigration procedures - that I may refer to so as to understand I have also screwed up? I will be hit for a fine for this as well, and was wondering what the reference material is to show I made a mistake by going to immigration at CW to get a year extension, but thinking the 90 day report would start 90 days after the yearly extension (2nd in my case), not 90 days after my last 90 days report.

Procedure and notification

  1. The foreigner makes the notification in person, or
  2. The foreigner authorises another person to make the notification, or
  3. The foreigner makes the notification by registered mail.
  4. The notification must be made within 15 days before or after 7 days the period of 90 days expires.
  5. The first application for extension of stay by the foreigner is equivalent to the notification of staying in the Kingdom over 90 days.

Thanks for that Ubonjoe, although I cannot get your from link to work, just takes me to this thread.

I suppose, even with my general understanding of English, that the above guidelines are lacking either the word ONLY prefixing point#5, or a point#6 saying that SUBSEQUENT applications for extension are NOT considered equivalent to the notification of staying in the Kingdom over 90 days, and the 90 day notifications need to be done also.

This might avoid the entrapment experienced by the people you mention like myself where notifications and extensions fell on the same week at the immigration office. At least after I go and pay my 2000 baht fine I shall remember next time, if there is one.

Hopefully if people read this it may help some who were confused.

When I picked up annual marriage extension in Khon Kaen in early Jan the officer changed the date on my 90 day report slip ( which was due in Feb) to April which was 90 days from when I picked up the extension. I haven't had that happen before.

Not sure how I managed to put the wrong link. It is correct now.

There's a notice on the glass top desk of the 90 day reporting counter at CW advising suckers like me who didn't know and are asked to pay 2000THB for not knowing that, in addition to the regulations listed above by Ubonjoe, says:

- Application of Visa extension is not deemed to be the notification of residence every 90 days.

Its a pity this isn't on the immigration web site as well as the CW office desk as it seems key to understanding the rule?
