Basically my wife and i have split up after being together for 10 years after finding out she was having an affair with someone who she works with, this was last month and in December my mother passed away so i have had a shit past few months. Now we have a 6 year old son who i care of the most as she works 5 nights a week and theres noway i will let him stay with her friends and ive basically packed in a well paying job so that i can look after him. Ive decide that i need a fresh start so im considering moving to Thailand for a bit and she is allowing me to take my son for 2 months, now what are my chances of getting full custody of my son in Thailand? My wife has moved in with her new boyfriend and she feels no guilt what so ever and i dont want son anywhere near her new bloke. I will also have written in Thai and English a letter stating that she is allowing me full custody of my son ive told her i need this to get a visa, im thinking i will have more chance in Thailand coz i know ive got no chance in the uk.

Married to the mother of your son, you automatically have full custody of your son. That is joint custody, not sole custody.

As long as you remain married, it is a private matter between you and your wife to decide with whom your son will live.

If you get divorced, a judge of the family court will decide regarding the custody of your son, based on what the judge considers to be in the best interest of the child.

That maybe not a easy strategy and is highly confrontational, but if you move to Thailand with you son, and your marriage is registered in Thailand, you can file for divorce on the basis of abandonment and sole custody of your son. Thai law does not allow the wife to stay away from the place where you the husband decide to live and much less to sleep with someone else. But, if your wife is any smart she would be able to fight your moves very effectively even from the UK.

Beside that, Thailand may not be the best place for a foreign single father and a culturally foreign kid.
