Need help about cancelling my previous WP3

My previous employer did a WP3 for me and I know it was approved from the Labour Department. However, I didn't use this WP3 to apply for a Non-B visa, that means I am still on a tourist visa(2nd) from Penang. Now, I am about to take on a new job and my new employer found out my previous WP3 is still in effect. I found the application of "wp cancellation" form on Labour Department's website states that I can cancel the wp on my behalf. Can I actually do that without bothering my previous employer? Thanks in advance!

You do not have a WP so can't cancel it. But with the form, without bothering the old prospective employer, you should be able to cancel the wp3.

If the work permit was never issued there is not one to be cancelled. The application would need to be withdrawn.

WP3 is simply the labour department form used by a prospective employer to apply for a work permit on behalf of someone who is outside of Thailand.

Maybe you have a WP3 Receipt (A5 Sized piece of paper) this shows that your papers were successfully filed, but the Work Permit should remain unissued as you never returned with a non immigrant 'b' 90 day entry stamp, so no need for cancellation.

To file a new WP1 application (not a WP3 as presumably you are now in Thailand), your previous employer, as a matter of courtesy, might have to withdraw the application on file, but normally the WP3 receipt states that the 90 day non 'b' stamp should be shown within a certain period, otherwise the WP application will expire and thus fail.

I don't know about WP1, because HR of my new employer insists on getting a WP3 for me to get a Non-B first. You see, WP3 is purely for Non-B application, once I get the Non-B, I can use that Non-B to apply for a work permit, isn't that right?

What you calling a WP3 is a work permit application receipt. At nearby embassies and consulates you need a work permit application approval letter from the Labor Ministry. The receipt alone is not enough to get a non-b visa.

You need the non-b in order for the work permit to be issued.

My experience with the Consulate in Penang, Malaysia is that without a WP3, no Non-B can be issued. Hence, no Work Permit application, right?

If you have not applied for a work permit you will not get a non-b visa at any nearby location.

Penang wants a work permit application aproval letter from the Labor ministry now. Just the receipt (aka WP3) for one is not enough.

WP1 is the form used to apply at the Thai Ministry of Labour for a Work Permit on Behalf of someone who is already in Thailand.

As ubonjoe has already posted, you need the Ministry of Labour Approval letter pretty much every where in the SE Asia Region now to support Non immigrant B Visa applications.
