SO I just went to the Immigration and was rejected for my 1 year extension due to not having a copy of the Rental Contract and copy of ID Card of our Land Lord and contact Phone Number witch is in My Wife's name..

Although I do have a Affidavit from my Embassy with my Address that is stamped and singed..

So After spending 4 hours I left very pissed off...

As far as I was aware We did not need to produce a Rental Contract..

From the Document I got from the Immigration department the requirements were

  • Application for extension of temporary stay in the Kingdom (T.M.7)
  • Two photographs 4x6 cm
  • Your valid passport
  • Marriage Certificate (In Thai and English) Thai Translation Legalized by Ministry of Foreign Affairs
  • Kor Ror 22 (Thai Registration of Marriage)
  • Valid ID card of the Thai wife
  • The House Registration of the Thai wife
  • Bank Statement from a Thai Bank showing a deposit of not less than 400.000 THB for 2 months
  • Letter of Certification from the Bank confirming existence of the account and certifying the deposit.
  • Map to Our Condo
  • Photo of Wife and Myself in the house and outside house ensuring one Photo shows House Address

So Once we got home we called our Land Lord and asked if he would provide his ID card.....

He refused...Stating No one do that especially for government application..

I told the wife to call him back and tell him if we cannot get his ID we cannot get my Visa so we cannot stay in Condo...

he said that's not the way to solve problem and we should just make fake contract and have Somchai the Mosi driver sign it as the owner and give his ID......

I said NO way ....

He is only doing it because he has not registered me on his book as resident and also is avoiding Tax income on the rent...Fing Prick..

So we are stuck.. I need to have residency somewhere??

I told the wife we will move...

She suggested that we go to her Home town and get my name on her House book witch she owns..

Then bring the House registration book, and owners papers along with copy's Do you think this will be enough??

All you need is a copy of your rental agreement. If your landlord is too idle to produce one move on & return the keys.

(Fare paying passenger an' all that; Something not everyone here comprehends!)

Some offices will insist on a copy of house book and ID card of the landlord.

And That is what she did

I pointed out the Affidavit but she was not interested only a Rental contract and DI card of owner..

Sounds good enough, except the 2 months of deposit money which is gone for sure.

What I was really looking for was

Or can I get a Yellow Book?

Go to Savannakhet and get a multi entry non 'O' visa

or get extension at wife home address

or do a 60 day visit wife extension, if time is paramount

you can not get on Thai house book

Copy of you wife house book is all you need (if you are staying in her house). They want to see the original house book too.

Then when you get your extension approved, just notify them of your new address.

and just have my address as her house in Korat?

Yes, that should do it. Just have in mind you must do the application and 90 day reports there (or mail it).

only thing with marriage extensions, they sometimes ask for neighbours to say you are living at that address, no doubt the lady will sort that out.

Sounds like we are heading to Korat then

Luckily I get on well with both the neighbors One is a Bank manager and has 2 sons who like to practice English with me

The other is a Ice ream vendor and is school friends with the wife.

Also the Bother in law and his wife are government workers who live in the house also One Local Police other is the School teacher ...

Should be good to go

Thanks for informing people of this problem !

I have already told my friends that when they sign a contract to rent condo or house to have a copy of the owner ID card and Blue book.

If renting from a foreigners.a copy of his passport and blue book to check who is listed there.

This way you know who is renting and who is listed in the book.

They do not want...do not rent....something may not be right !

Actually, in this case the landlord is half right... by that I mean a contract with any old somchai named and his ID card will suffice.

Or.. a really elegant solution would be to agree with the landlord that it's actually your wife who rents the condo from him. Then get your wife to rent the condo to you and produce her ID card etc... that will work 100%

The person renting to you need not own the property, and their family book can be anywhere,

In our condo building the standard practice is for the juristic manager to supply the letter for immigration and not the actual owner of the condo. He and his office staff are the ones who submit the form to Immigration, also, to notify of new foreign residents, too, not the actual owners of the condos.

The was the case, also, in another condo building where we rented here in Chiang Mai. The manager hired by the condo board gave us the letter verifying we rented and lived there and a copy of her ID.

I find this practice very convenient, rather than having to make contact with owners who often are overseas.

Your extortionist of a Landlord has probably done this before and every time he score the deposit when people are forced to move out - what a sh1tface he/she is, amazing Thailand ...

Go buy a house. If you can afford paying a rental, buy! Then just show the house book with your wives name and ID card.

not picture of house and you needed. Wife is Landlord! No need for bank statement showing $400,000 baht. Get statement from US or GB Consulate showing income. Plain and simple!

Yep hold on a minute I will just pop down to my gold vault and grab a few sacks of gold bar I have tucked away for such an occasion......

Also cant get an Income statement from my Consulate as I am not on a fixed income and often go for 2-3 months without working.

I think changing your extension of stay application to Korat so that you can use your wife's house book as proof of residence is not a good idea. It will just create more complication than it is worth. Changing to another office means immigration will do a home visit or want witnesses. You would need to return to Korat after the 30 day under consideration to get your extension stamp. Korat does not accept 90 day reports by mail so you need to do them in person there.

You should give formal notice to your landlord that you are moving in 30 days and state the reason for moving is that he will not provide the required documents for your extension. That might get him to hand over a copy of his ID card.

You could apply for a 60 day extension to visit your wife if you cannot get things sorted before your extension ends.

You make the application and the you get extended for another 30 days while they process the application/make the checks?

If that is the case during the 30 day Processing do I have to stay in Thailand?? As I may need to travel for work??

I assume you mean a 90 day entry not an extension. You can apply for your extension during the last 30 days of your 90 day entry.

The 30 days is a report back date for the under consideration period which will start from the date you apply for the extension at Chaeng Wattana. If you did it at Korat it would start from the end of your 90 day permit to stay you have now. You can get a re-entry permit for the under consideration period.

I would put some pressure on your land lord to do the rental agreement and give you a copy of his ID card. Immigration does not report anything to the revenue department if that is what he is worried about.
