Expats' Succession now follows Thai Law

Hi. A very interesting point in this month French Embassy's Newsletter.

This concerns all European people (and people who own lands, house... in Europe ?)

It's about The New EU Regulation 650/2012 on International Successions that will apply to successions opened from 17 August 2015.

In short this regulation will make things easier in the general case :

Only your country of residence will manage your succession, even for goods you own in other countries.

The principle: application of the law of the State in which the deceased will have his/her habitual residence at the time of death, even if this is the law of a State that is not a member of the European Union. A single law will govern the whole succession.

Expats in Thailand : It's Thai law that will soon apply on your goods or house in Europe too...

Of course you can modify this "by default" rule by making a will, but from my Embassy very few expats make one... until today.

And presume "successions" means what happens after you die?

2- Yes, "succession" used here as the process after you die,

like here: The act or process of becoming entitled as a legal beneficiary to the property of a deceased person

How can the EU influence laws of non-EU countries?

It can't.

The title is totally misleading. The story has nothing to do with Thailand.

It's about European expats working in another European country and who haven't made a valid will.

Succession Laws in Thailand apply when you die intestate ie no Will

so the assets go to the wife or children in % as laid down by Thai Law

If you nominate people in your Will then those beneficiaries should receive parts of your estate that you have left to them

So people please spend a few baht and make a Will
