I am new to the forum and allows me to ask for help


I live on Koh Samui-thai with my partner (not married) and our Franco-thai son.


He was born here in Koh Samui-there 4 years.

I would like a family O visa is the father of my child thai.


- Do you know if this is possible without marriage, and what is the procedure?


I think I need to consult a lawyer specializing in family affairs in order to obtain the birth certificate formalized by a judge.

- If someone at an address to communicate on the island, I'm interested.

You can get a visa at a consulate abroad but must make border runs every 90 days.

As you are not married to the mother you are not the legal father of your child unless you have gone through the courts.

Being on the birth certificate means nothing to Thai authorities.

You can not get one year extension at immigrations in Thailand as you are not married or have a legitimate child.

You will need a lawyer, for the court where the child is registered at the household registration book.

You do not need a fancy lawyer, as it is a straight forward case if the mother cooperates. But it will take a couple of months to be legally recognised as the father.

Do shop around for a lawyer and choose one with an acceptable price.

In the mean time you could get a 60 day extension based on your child with the birth certificate naming you as the father. You would need child (and preferrable the mother) joining you to immigration with birth certificate and household registration book.

My son was born in Koh Samui, but recorded in the book of her mother in Udon Thani.

You will have to use the family court in Udon, as that is where the child officially lives.

Can't recommend anyone there. Just try a few and sees who has an agreeable price.

Do you or your child's mother know a Thai that has a house book for Samui or within Surat Thani province that would allow your child to be listed on it. That would be better than trying to do it in Udon.
