Overstay by 1 day is there any leniency?

Recommended Posts

I have overstayed by one day and going through the land crossing to Cambodia had to pay the 500 baht fine, fill out some paperwork, etc. It does not take long. Actually it was quite pleasant as it was a slow day, the young lady was very friendly and when asked I said I was just extending my holiday, I was an engineer (I answered in Thai). A very friendly chat on the surface anyway. I don't have any unusual visa activity on my passport. Just one trip a year for the last several years. I have heard that if you are leaving from the airport BKK, you have a one day grace period.

Per above. At airports there is a 1 day grace period, at landborders not.

In both cases the passpot gets stamped as having been on overstay and at the airport you should allow some extra time for this. (Normally it doesn't take long, but don't check-in at the last minute).

I have "Non B" visa and WP. Last month I had to go for a quick border run.
Due to bad weather, I overstayed by 8 hours.

Crossing from Sadao in to Malaysia, I paid 500 THB which was expected
but I was told by the fat man in charge, I could not return on the same day,

otherwise he'll shoot me, pointing at his pistol. smile.png

If leaving from either airport in Bangkok their is no overstay fine charged for an overstay of less than 24 hours. Other airports may charge the fine. You pay for an overstay at any border crossing.

The last time I did a one day overstay (over a year ago) there was no overstay stamp at the airport, it was completely disregarded and I only received the regular stamp out.

I have done multi day overstays in the past where I had to pay a 500 Baht / day fine and got the stamp so there is no confusion here.

Maybe they've changed the policy recently.

I have a couple of less than 24 hour overstay stamps in an old passport that the officer did when he stamped me out of the country. They are in Thai and say that I overstayed for less than 24 hours.

One other point. How long stay do you get for a border crossing at MaeSai? We are entering on triple 60 day but if we are over we probably will do an earlier border crossing. I have been told 15 days to 1 month depending on where you are from. Which is it does anyone know?

Thanks again,

why do you have to do a Visarun when you actually have a WP ?

Many people that have a work permit cannot qualify for a one year extension of stay based upon working. Getting a work permit does not always qualify you to get an extension.

So the only choice they have is to get a multiple entry visa.

Sorry, haven't seen your posting as I was just a few days in Malaysia.

I live fairly close to the border and quite like a couple of days out of the country.

A good excuse to be away from home for a couple of days, plus a bit less paperwork

and instead of waiting in the q at immigration, I have a nice cool beer whilst my new

visa is processed wink.png

.

If I get extension of stay, I wouldn't move at all anymore wink.png

I think it's down to the discretion of the immigration officer at the airport,

if you have to pay the 500 THB or not, if you overstay by less than a full day.

No is not at the discretion of the immigration officer if leaving from an airport in Bangkok. It has been written policy/regulation for many years.

It should be the same at all airports since they are all under immigration division 2 but it is not.
