Marriage visa after divorced

After reading conflicting information on different posts, I'd like to receive confirmation on what happens to your marriage visa when you divoce?

I've read:

. it's voided the moment you sign the divorce papers at the amphur so you should get another visa before signing (like a tourist visa)

. visa is voided but you still have 7 days to cross the border

Which one is it? Or is it something else?

IMO the extension is voided as soon as you are divorced, but you still get 7 days to cross the border. Amphur will not void the extension that would be done at the Immigration office

Edit: question, do you have an extension of stay from Immigration or a Multiple Entry Non-O visa ?

You would (after the divorce) need to goto your Immigration and show them that you got divorced, they will cancel your extension and after paying 1900 THB they will give you a 7 day "extension", then you have 6 days (day you apply is day 1) to leave the country and apply for a new visa at an Embassy or Consulate outside of Thailand.

Edit: If you get that 7 day "extension" you will not get fined if you leave within the time given to you. If you leave afterwards you would be on overstay

Unless you can apply for another extension of stay (If you have children one based upon that or perhaps retirement ) there is no reason to go to immigration. Just leave the country and get a new entry of some kind.

One suggestion I have is if you are still on good terms with your soon to be ex wife and she would give you signed and dated copies of her house book and ID card you could go out for a multiple entry non-o visa in Savannakhet before you get divorced. A visa will remain valid after the divorce.

It looks like we'll share custody of the kids. If I pay alimony for children when we are divorced, can I ask to renew my non-O next year, as a family support?

You could apply for an extension based upon being the father of a Thai as soon as you are divorced and you have the documents proving joint custody.

You would have to meet the same financial requirements as you showed for marriage.

Would he need to return / destroy the marriage certificates after a divorce?

Or, could the 'good terms' arrangement with the ex-wife continue year after year with new multiple entry non-o's from Savannakhet?

My understanding is that you do return the marriage certificates in exchange for the divorce certificate.

Anyway, I can't picture myself keeping such 'good arrangement' year after year after year...

Indeed, upon divorce the marriage certifictes must be returned and one gets a divorce certicate. Whih must be returned if one get married again.

Good to know, is that when applying for extension based on Thai child, money in the bank does not have to be seasoned for two months.

If i was you i would make sure that its done legally, because as im starting to find out and im going through the same thing at the moment, if you dont pay what they want they get real real bitchy and in my case dont mind upsetting or not seeing the kids to make there point.

My advice would be to keep the originals for wedding and birth certs and worse case scenario you can get a 12 month Non- O from Savannaket.

is it ok to have joint custody to get the extension, a few people say that you need to have sole custody to get the EOS, im looking into this for myself also.

The written rules just state you need to be the parent of a Thai. There is no mention of custody.

I reality it all depends upon the immigration office where you apply/ Their have been people that have gotten the extension with joint custody.

Im in the same situation. I was divorced as well but still have most of the docs.

Im heading to Savannakhet soon and I have all the documents required except for one thing.A current Thai ID. I do have my wife's Thai passport but it expired a few months ago.

Unless they can accept a recently expired passport? I highly doubt it.

This is the same wife that I helped and supported but had a bad break up so cannot get a current Thai ID.

Unless this would be ok? (im very sure it wont)

You will need signed copies of her house book registry and ID card. They will accept nothing less.

I have older copies of both the house book registry and Thai passport that is signed without a date.

We did this last year prior to the divorce.

So maybe it can work since I do have the copies (just that the ID expiered a few months ago)
