Tenant gets man in trouble

BANGKOK: -- The Criminal Court yesterday sentenced a man to two years in jail for renting his flat to a red-shirt activist to install equipment used to scramble radio frequencies of the Office of the Maritime Promotion Commission.

The owner of the room, Theerapat Bunpa, and red-shirt activist, Chinnawat Habunpad, were charged with colluding to possess and use radio communications equipment without permission, establishing a radio communications station without permission as well as scrambling and blocking official radio communication.

The prosecutors said they breached Sections 6, 11, 22 and 23 of the 1955 Radio Communications Act.The duo committed the offences from January 9 to April 12, 2009 at MP Tower in Bangkok's Din Daeng district. Their alleged intent was to block or disturb radio frequencies of the Office of the Maritime Promotion Commission.

Both defendants have pleaded not guilty.

Chinnawat failed to show up at the hearing today and now faces an arrest warrant. Theerawat testified that he had unknowingly rented the room to Chinnawat, who used it as a base to scramble the signals.

The court said Theerawat's claim that he had no idea of what Chinnawat was doing carried no weight because he obviously knew something, which is why he charged more than Bt10,000 per month in rent. Theerawat's three-year sentence was communted to two as he provided useful testimony.

His lawyer will apply for a Bt200,000bail and file an appeal.

Now forgive me for being rather naive, but if an anti-government activist wants to cause some problems by jamming (I'll ignore the 'scramble') some radio frequencies, surely they would go and jam police channels, aircraft frequencies or the like?

Probably because he was collecting 3-4 times the rental rate for that location.

If a landlord is offered even twice the going rate for his place, he would be automatically asking himself why this person would pay so much if not to use the place for some fishy business.

Your logic implies that if a Farang is charged double the going rate for something (e.g. jet ski), then the Farang is up to some fishy business during the 30-minute rental period?

Nothing to do with logic or your rationalisation.

OP clearly states it was courts reasoning and it was not a farang renting, nor do farangs pay double or triple the price for rents.

Under the scientific theory method, it is a working hypothesis that agrees with all the known facts, and should be accepted until proven wrong by new facts, or a theory which better suits the known facts is produced.

Simply yelling "the Earth is flat." helps nobody.

The OMPC operates within the merchant marine sector collecting data, doing analysis and acting as a clearing house for technical data. Nothing is mentioned in the article as to a motive for allegedly blocking signals. What exactly was there to be gained politically by jamming signals? The allegations are rather strange. If anything this sounds more like a criminal enterprise than a political event. The use of the term "red shirt" is a convenient catchall. Whenever there is someone to blame, it is easy to call the person a "redshirt". What was the motive?

The Red Shirts are a term for the UDD, It has at times been closely aligned with the PTP, but it is an independent umbrella organization that encompasses a wide range of political groups. The claim that the UDD is controlled by the PTP or the former PM Thaksin is a simplistic explanation. The UDD includes right wing nationalists, social activists, right wing reactionaries, reformed communists, farmers groups etc. There is a significant faction that detests/loathes Thaksin, and that is putting it politely. Sometimes I think they hate Thaksin more than some of his detractors in TVF,

in any country it's an obligation of the landlord to know what tenant does in rented property. that's why the owner has a right to inspect the property.

So what do you think and do when the Gov official policy is to charge some poel 10X more than otheres? It is standard for many Thais to charge us pesty Farlangs 3 times the going rate.

I haev seen many times Farlang pay more for rent. But the Thai land loard never goes to jail.

Whatever this is about, it took some planning, which means it came from The Boss. What could they have in mind that would involve marine traffic? And he's been at it for two years.

I don't know about the relations between the army and the navy, or coast guard.

Or is this stuff about radio equipment nonsense, and it's just a case of getting another red off the street?

Can't find MP Tower rents but 10,000 bt/month seems the norm in that area.

Yes, it was just a criminal enterprise, run by a common criminal and has nothing to do with the red shirts or PTP. The facts that Mr Chinnawat just happens to be a "key" red shirt leader, and a former PTP party list MP, are just as coincidental as the resemblance his adopted name has to the surname of a certain other family of common criminals. My, all those criminals. It's almost as if being one was a pre-requisite for admission to the upper levels of the UDD, and the PTP party list. Or both when it comes to this guy. And Jatuporn, And Weng. And Nattawut. And....... But there's no link between them. No siree.

So, the landlord knew enough useful information to get a year shaved off his sentence, but claims he knew nothing at all? There may be hope for Yingluck. "I know nothing". "That's useful information. Sentence is reduced by a year".

Except... it was not a Farang, far more than a thirty minute rental was involved, and three to four times average is twice double the going price. The logic is spot on...something fishy was indeed in the works, and the landlord should have been a wee bit suspicious at the very least.

Certain governments in Thailand have been going after Chinnawat Habunpad for some time. In 2010, he was included on a list of people targeted as possible financial backers of red shirts. A bunch of people were rounded up in that effort. He was also name in potential sedition charges in 2011. Nothing came of this.

This radio interference charge stems from activity in 2009.

It seems the current government has dusted off some old case files.

It's stuff like this that suggests the Thai judicial system is highly susceptible to political influence.
