Order No. 543/ 2549

Authorization Granting Pursuant to the Immigration Act B.E. 2522

The Royal Thai Police view as appropriate to revise the Order No. 707 / 2540 dated on 27th June 1997 subjected about the authorization granting pursuant to the Immigration Act B.E. 2522 and the Order No. 474 / 2548 dated on 30th June 2005 subjected about the authorization granting pursuant to the Immigration Act B.E.2522 (Additional Order) to be up to date and more effective;

By the virtue of the Second Clause of Article 26, Article 35, 36, 47 and 59 of the Immigration Act B.E. 2522 and the Article 74 of the Royal Thai Police Act B.E.2547, the Royal Thai Police Commander hereby stipulates the Order with the details as follows:-

1. The following Orders shall be canceled:

1.1 Royal Thai Police Department Order No. 707/2540 dated on 17th June 1997 subjected about the authorization granting pursuant to the Immigration Act B.E. 2522,

1.2 Royal Thai Police Order No. 474/2548 dated on 30th June 2005 subjected about the authorization granting pursuant to the Immigration Act B.E. 2522 (Additional Order),

This Order shall be superseded to all other orders which are contradicted to this Order.

2. If there is a necessity to set up a checkpoint of vehicle at any place apart from the places that the Royal Thai Police Commander has stipulated according to the Article 26 of the Immigration Act B.E. 2522, the Chief of the Immigration Checkpoint shall be authorized to grant the permission.

3. Any permission which is granted to allow foreigners to stay temporarily in the Kingdom of Thailand under the Article 35 of the Immigration Act B.E. 2522 shall be made by the authorized Immigration Officer. The permission shall be made based on the type of VISA which being held by the foreigner as follows:

3.1 Foreigner who holds the Transit Visa shall be permitted to stay temporarily in the Kingdom of Thailand for the period that is not exceeding 30 days.

3.2 Foreigner who holds the Courtesy Visa shall be permitted to stay in the Kingdom of Thailand according to the following conditions:

3.2.1 Holder of the diplomatic passport, official passport, United Nations passport, shall be permitted not exceeding than 90 days.

3.2.2 Foreigner who is the visitor of the King’s Monarchy, or Thai government or any government sectors shall be permitted for the specific period of time as will be viewed as necessary.

3.3 Tourist Visa holders shall be permitted to stay in the Kingdom not exceeding 90 days.

3.4 NON-Immigrant Visa holders shall be permitted to stay in the Kingdom of Thailand not exceeding 1 year.

3.5 Diplomatic Visa holders shall be permitted to stay in the Kingdom for the specific period of time as will be viewed as necessary.

3.6 Official Visa holders shall be permitted to stay in the Kingdom for the specific period of time as will be viewed as necessary.

3.7 Permission granted according to the Condition 3.1 to 3.6 mentioned above shall be approved by the authorized immigration officer only one time.

4. In case the foreigner has any necessity to stay longer than the permitted period stated in Condition 3, The Commander of the Immigration Bureau shall be authorized to legally make the decision to grant or deny granting permission. In case the permission is granted, the granted permission shall not be exceeding permission of one year. Except for the following cases:

4.1 Foreigner who enters the Kingdom of Thailand pursuant to the Article 3.4 (1) and (2) shall be permitted to say as long as necessary.

4.2 Foreigner who enters the Kingdom of Thailand pursuant to the Article 3.4 (7) shall be permitted to stay for the period of time that is approved by The Board of Investment of Thailand (BOI).

5. If foreigner who is exempted from Visa requirement, or the citizens of any country that has made the agreement of exemption of Visa requirement with the Government of Thailand, and the citizens of the country that is required to show Visa for checking and approval at the Immigration Office, that has stayed in the Kingdom reaching the expiration of the granted period, but has any necessity to stay longer. In this case, the Commander of the Immigration Bureau shall be authorized to solely make the decision to grant or deny granting permission. In case the permission is granted, the granted permission shall not be exceeding one year per granted permission.

6. With the prior written consent of the Royal Thai Police Commander, the Commander of the Immigration Bureau may grant the power of attorney to any commissioned police who works for the Immigration Bureau to be the lawful authority who has the right to grant or deny granting the permission to the foreigner to temporarily stay in the Kingdom of Thailand in accordance with the Item 4 and 5 mentioned above.

7. The Commander of the Immigration Bureau shall be authorized to cancel or revoke the permission which is granted to the foreigner to temporarily stay in the Kingdom of Thailand in accordance with the Article 3.6 of the Immigration Act B.E.2522.

8. The Immigration Officer who is ranked as the Police Inspector shall be authorized to issue the certification of residence for the foreigner who is granted to have the residence in the Kingdom of Thailand in accordance with the Article 47 of the Immigration Act B.E.2522

9. The Immigration Officer who is ranked from the Deputy Police Inspector or higher shall be authorized to arrest and repress the misdemeanant who breaches the Immigration Act B.E. 2522 and shall be authorized to press any summons, or remand the misdemeanant, and arrange the investigation under the Article 59 of the Immigration Act B.E. 2522.

This Order shall become in full force commencing from the 1st October 2006.

Subject: Procedure in Permitting Foreigners to temporarily enter in the Kingdom

Referring to the National Police Office Order Number 543/2549 dated August 15th, 2006 Immigration Bureau concerning the Delegating the Authority according to Immigration Act 1979 A.D. Outlining the authority in permitting foreigners to temporarily entering in the Kingdom where it would be in affect as of October 1st, 2006.

The order was to grant authority to the Immigration Bureau Officer to be responsible for the permitting of foreigners to temporarily entering in the Kingdom in order to control the foreigners in harmony and suitable with the current situation as per the following condition.

1. Foreigners who temporarily entering the Kingdom on a Transit Visa are permitted to stay for a period of no more than 30 days.

2. Foreigners who temporarily entering the Kingdom on a Courtesy Visa on the basis of the following:

2.1 In the case if the foreigner holding a diplomatic passport or governmental document or United Nations’ passport are permitted to enter the Kingdom for a period of no more than 90 days.

2.2 In the case if the foreigner is a Royal Guest or Parliament Guest are permitted to enter the Kingdom until the mission accomplish.

2.3 In the case if the foreigner is a Governmental Guest are permitted to enter the Kingdom for a period of no more than 90 days.

3. Foreigners who temporarily entering the Kingdom on a Tourist Visa are permitted to stay for a period of no more than 60 days.

4. Foreigners who temporarily entering the Kingdom on a Non-Immigrant Visa are permitted to stay for a period of no more than 90 days with condition directed accordance to the objective.

If the Foreigners which permitted to enter the Kingdom have an “A” stated after the condition directed shall be permitted to stay within the Kingdom for a period of no more than 1 year starting from the day of the arrival.

5. Foreigners who temporarily entering the Kingdom on a Diplomatic Visa are permitted to stay for a period of no more than 90 days.

6. Foreigners who temporarily entering the Kingdom on an Official Visa are permitted to stay for a period of no more than 90 days.

90 days? So what if work entails a longer stay....4-5 years? Renew every 90 days??

Can you post also the Thai original, to print out and show to the immigration officer on arrival in case the officer is not familiar with the new rules?

Does this mean that when I arrive at Bangkok airport on 23 November 2006 with a single-entry non-O visa I will be admitted until 22 November 2007?

90 days? So what if work entails a longer stay....4-5 years? Renew every 90 days??

I was in one of those categories. It means you get a Courtesy visa (stamp at the airport) and you can stay 90 days in Thailand if you have one of the above passports. I.e. you can go for meetings, visits etc and no visa needed.

If you go for a tour of duty in diplomatic or UN in official capacity you get a multiple entry official wisa "F" and a stay permint for the duration of service.

Maestro..........no with a single entry you will only recieve a 90 day stay (obviously if you meet the requirements you may extend this stay up to the year).

If you have a multiple entry then you still need to complete the 90 day border runs.

If you have a Non Imm O-A then yes you would recieve a years stay stamp upon arrival.
